RESOLUTION NO. 6104
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIRS TO DM4AGED SIDEWALKS, DRIVE-
WAYS AND CURBS (SR-80-7)
WHEREAS~ the Street Superintendent of the City of Santa Monica, pursuant
to Section 5600 to 5630 of the Streets and H1ghways Code, commenced proceedings
to cause the repa1r of damaged sldewalks, driveways and curbs in the C1ty of
Santa Monica, and
WHEREAS, Slxty days after said order was served, the work had not been
completed by the owners or persons 1n possession of the affected properties,
and the Super1ntendent of Streets caused the work to be done, and
WHEREAS, the Superlntendent of Streets did file wlth the C1ty Council of
the C1ty of Santa Monica his reports of such work, and a hear1ng thereon was
called by Resolution No. 6089 (CCS); and
WHEREAS, the City Council conducted a noticed hearing to consider any
protests or obJections to the reports of the work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the Superlntendent of Streets
heretofore filed and above descr1bed, be and the same is hereby confirmed.
SECTION 2. That all of sa1d protests and objections of every kind and
nature to the repairs or to the assessments and all appeals therefrom to
said City Counc1l be and the same hereby are overruled and denled.
SECTION 3. That the cost of the repairs, as set forth in said Report,
shall be assessed agalnst the properties herein described, WhlCh properties
front upon the 1mprovement so constructed.

SECTION 4. That if such assessment is not paid wlthin the time permitted
by law the same shall constitute a special assessment and lien against the
properties therein described, 10 the amount set forth in said Report, wh1ch
lien shall continue unt1l the assessment and all interest thereon 15 paid.
SECTION 5. That if the assessment is not pa1d within the time permitted,
the C1ty Clerk shall deliver a Notice of Lien, signed by the Superintendent
of Streets, as provided in Section 5626 of the Streets and Highways Code of
the State of California, to the County Assessor and Tax Collector, who, in
accordance with applicable law. shall collect said assessment, together with
all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the adoption of this
Resolution.
