R-6111 . . r RESOLUTION6111 (CCS) (City Council Ser1es) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO CONSTRUCT GUTTERS ALONG PORTIONS OF ARIZONA AVENUE, ALL WITHIN THE CITY OF SANTA MONICA. WHEREAS, the Clty Counc11 of the City of Santa Monica is empowered by Sect10n 5870, et seq. of the Streets and Highways Code of the State of California to construct gutters at various locations w1thin the City of Santa Monica' NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest requires and 1t 1S the 1ntent10n of the City Council of the City of Santa Mon1ca to order the following work to be done, to W1t. The construction of concrete gutters along Ar1zona Avenue between 19th Court and 20th Street between 22nd Street and 22nd Court. The estimated assessment cost of the 1mprovement is $8.50 per front foot. SECTION 2. That said proposed work or improvement in the opinion of the City Council of the City of Santa Monica is of more than local or ord1nary public benefit, and said Council hereby proposes that the district 1n the City of Santa Monica to be benefited by said work or improvement and to be assessed to pay the cost and expense thereof, includes all of the commercially-zoned property abutting Arizona Avenue between 19th Court and 20th Street between 22nd Street and 22nd Court. -1- . . SECTION 3. Notlce hereby is glven pursuant to said Section 5870 et seq. that on November 25, 1980, at the hour of 7:30 p.m. 1n the Counc11 Chambers ln the City Hall of sa1d C1ty of Santa Mon1ca, situated at 1685 Main Street 1n said City, any and all persons having any objections to the proposed work or improvement may appear before the City Council and show cause why the said proposed work or improvement should not be carried out in accordance with said Resolution of Intent1on. SECTION 4. The Superintendent of Streets immediately shall cause to be conspicuously posted along the llne of said contemplated 1mprovement not1ce of the passage of this Resolution of Intention in the manner and form prescr1bed by law. The C1ty Clerk hereby is d1rected to mail notice, 1n the manner and form prescribed by law, of the adoption of this resolutlon to all persons owing real property in the here1nbefore described assessment district, whose names and addresses appear on the last equalized assessment roll for city taxes or as known to the C1ty Clerk. SECTION 5. That 1f the property owner does not notify the City w1th1n 15 days after the public hearing that he will do the work h1mself then the City will commence the reqU1red work. SECTION 6. The City Clerk shall certify to the adoption of this resolutlon and thenceforth and thereafter the same shall be in full force and effect.
