A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DECLARING ITS INTENTION TO CONSTRUCT GUTTERS
ALONG TWENTY-EIGHTH STREET BETWEEN PICO BOULEVARD AND
OCEAN PARK BOULEVARD ALL WITHIN THE CITY OF SANTA MONICA
WHEREAS, the City Councll of the C1ty of Santa Monlca is
empowered by Sect10n 5870, et seq. of the Streets and H1ghways Code of the
State of Callforn1a to construct gutters at various locatlons within the Clty
of Santa Monica;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOllOWS:
SECTION 1. That the publ1C lnterest reqUlres and it is the
lntentlon of the City Council of the City of Santa Monica to order the followlng
work to be done, to wit: The construction of concrete gutters along Twenty-
E1ghth Street between Pica Boulevard and Ocean Park Boulevard all in the City
of Santa Monica. The estimated assessment cost of the improvement is $8.50
per front foot.
SECTION 2. That said proposed work or improvement in the op1nion
of the C1ty Council of the City of Santa Monica is of more than local or
ordlnary public beneflt, and sald Council hereby proposes that the d1strict 1n
the Clty of Santa Monica to be benef1ted by said work or lmprovement and to be
assessed to pay the cost and expense thereof, 1ncludes all of the property
abutting Twenty-Eighth Street between Pico Boulevard and Ocean Park Boulevard.

SECTION 3. Notice hereby 1S given pursuant to sald Section
5870 et seq. that on November 25, 1980, at the hour of 7:30 p.m. 1n the Councll
Chambers ln the Clty Hall of said C1ty of Santa Monlca, sltuated at 1685 Main
Street in said City, any and all persons having any object10ns to the proposed
work or improvement may appear before the City Councl1 and show cause why the
sa1d proposed work or improvement should not be carrled out in accordance wlth
said Resolutlon of Intention.
SECTION 4. The Superintendent of Streets 1mmediately shall cause
to be consplcuously posted along the line of sa1d contemplated 1mprovement notice
of the passage of this Resolution of Intentlon in the manner and form prescribed
by law.
The C1ty Clerk hereby lS dlrected to mall notice, 1n the manner and
form prescribed by law, of the adoption of th1S resolutlon to all persons owning
real property ln the here1nbefore described assessment district, whose names
and addresses appear on the last equalized assessment roll for city taxes or as
known to the City Clerk.
SECTION 5. That if the property owner does not not1fy the City
within 15 days after the public hearing that he will do the work h1mself then the
C1ty wlll commence the required work.
SECTION 6. The Clty Clerk shall certlfy to the adoption of this
resolut10n and thenceforth and thereafter the same shall be in full force and
effect.
