R-5209 ~. -- " -- flee RESOLUTION NO. _5209 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPERIN- TENDENT OF STREETS REGARDING RECONSTRUCTION OF TENTH COURT BETWEEN OLYMPIC BLVD. AND 450 FEET NORTHWESTERLY OF OLYMPIC BLVD. WHEREAS, The City Council of the City of Santa Monica, pursuant to Section 5870, et seq., of the Streets and Highways Code, commended proceedings to cause the reconstruction of Tenth Court between Olympic Blvd. and 450 feet Northwesterly of Olympic Blvd. in the City of Santa Monica, and WHEREAS, a public hearing was held on said matters, and there- after said City Council ordered said reconstruction to be accomplished; and WHEREAS, sixty (60) days after said order was served, the work had not been completed by the owners or persons in possession of the affected properties, and the Superintendent of Streets caused the work to be done; and WHEREAS, the Superintendent of Streets did file with the City Council of the City of Santa Monica his reports of such work, and a hearing thereon was called by Resolution No. 5171 (C.C.S.); and WHEREAS, the City Council conducted a noticed hearing to consider any protests or objections to the Reports of the Work. NOWt THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the Report of Work of the Superintendent of Streets heretofore filed and above describedt be and the same is hereby confirmed. - . -- _e_ SECTION 2. That all of said protests and objections of every kind and nature to the work or to the assessments and all appeals therefrom to said City Council be and the same hereby are overruled and denied. SECTION 3. That the cost of the work, as set forth in said Report, shall be assessed against the properties herein described except when other arrangements have been made with the City, which properties front upon the improvements so constructed on Tenth Court between Olympic Blvd. and 450 feet northwesterly of Olympic Blvd. SECTION 4. That if such assessment is not paid within the t1me permitted by law the same shall constitute a special assessment and lien against the properties therein described, in the amount set forth in said Reports, which lien shall continue until the assessment and all interest thereon is paid. SECTION 5. That if the assessment ;s not paid within the time permitted, the City Clerk shall deliver a Notice of Lien, signed by the Superintendent of Streets, as provided 1n Section 5891 of the Streets and Highways Code of the State of California, to the County Assessor and Tax Collector, who, in accordance with applicable law, shall collect said assessment, together with all other taxes relating to such property.
