R-5290 ~ ~ . e. e e e RESOLUTION NO. 5290 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPER- INTENDENT OF STREETS REGARDING TREE PLANTING DISTRICT NO. 5 WHEREAS, the City Council of the City of Santa Monlca, pur- suant to Section 5870~ et seq., of the Streets and Highways Code, com- mended proceedings to cause the planting of trees on Lincoln Boulevard between Pacific Street and Ocean Park Boulevard in the City of Santa Monica, and WHEREAS, a public hearing was held on sald matters, and thereafter said City Council ordered said planting to be accompllshed; and WHEREAS, sixty (60) days after said order was served, the work had not been completed by the owners or persons in pOSsesslon of the affected properties, and the Superintendent of Streets caused the work to be done; and WHEREAS, the Superlntendent of Streets did file wlth the City Councll of the City of Santa Monica his reports of such work, and a hearing thereon was called by Resolution No. 5221 (C.C.S.); and WHEREAS, the City Council conducted a noticed hearing to consider any protests or objectlons to the Reports of the Work. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the Reports of Work of the Superintendent of Streets heretofore filed and above described, be and the same is -1- -. e e. hereby confirmed. SECTION 2. That all of sa1d protests and objections of every kind and nature to the planting or to the assessments and all appeals therefrom to said City Council be and the same hereby are over- ruled and denied. SECTION 3. That the cost of the plantlng~ as set forth in sa1d Reports, shall be assessed against the properties herein described, which properties front upon the improvement so planted. SECTION 4. That if such assessment is not paid within the time permitted by law the same shall constitute a special assessment and lien aga1nst the properties there1n descr1bed~ in the amount set forth 1n said Reports, which lien shall continue until the assessment and all lnterest thereon 1S paid. SECTION 5. That if the assessment is not paid within the time permitted, the City Clerk shall dellver a Notice of Lien, signed by the Superlntendent of Streets~ as provided 1n Section 5891 of the Streets and Highways Code of the State of California, to the County Assessor and Tax Collector, who~ in accordance with applicable law, shall collect said assessment, together with all other taxes relatlng to such property. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution.
