THE CITY OF SANTA MONICA DECLARING
ITS INTENTION TO GRANT A FRANCHISE
TO SOUTHERN CALIFORNIA GAS COMPANY
AND FIXING THE 'rIME AND PLACE FOR A

WHEREAS, the C~ty of Santa Monlca Granted a franchise
for the transm~SSlon and d~strlbution of natural gas in the
C~ty of Santa Monica-to Southern Counties-Gas Company of
California, a predecessor of Southern California Gas Company
on or about May 3, 1937; and,
WHEREAS, said franchise has expired; and,
WHEREAS, it is necepsarYvto provide for th~ transmission

State of Californla, includlng the C~ty of Santa Monlca, an
application, und~r~nd pursuant to the provls~ons of Divislon 3,
Chapter 2 of the Public Utllitles Code of the State Of
Cal~forn~a and the City Charter of the City of Santa Mon~ca,
for a franchise, wh~ch said appl~cation states, in compliance

of Santa Mon~ca, that the purpose for which "the franch~se
therein applied for is deslred 1S to lay and use pipes and
appurtenances for transmlttlng and dlstributlng gas for any
and all purposes under, along, across or upon the publ1C
streetsl ways, alleys, and places as the same may now or may
hereafter eXlst wlthin the C~ty of Santa Monica; and that the
term for wh~ch the franchlse there1n applied for is indeterm~nate,
as defined in Section 6264 of the Public Ut1lities Code and
Section 1602 of the C1ty Charter of the C~ty of Santa Monlcai
and,
WHEREAS, sald appl~cation further states that the
applicant, if granted the franchise thereln applied for, will
pay to the Clty of Santa Mon1ca during the life of such
franclse, two (2%) percent of the gross annual receipts of
appl~cant arlslng from the use, operatlon or-possesslon of
said franchise; provided, however, that such payment shall in
no event be less than one (1%) percent of the gross annual
recelpts of applicant derived from the sale of gas w1thln the
llmlts of the < City of Santa Mon~ca under said gas franchise.
NOW, THEREFORE, the Clty Council of the Clty of
Santa Mon~ca does resolve as follows:
SECTION 1. That the City Councll of the City
of Santa Monica, pursuant to the provlsions of Section 6205
of the Public Utilities Code of the State of California, and
Section 1601 of the City Charter of the City of Santa Monica,

does hereby declare its intent~on to grant a franchise to
lay and use pipes and appurtenances for transmitting and
d~stributing gas for any and all purposes under, along, across
or upon the public streets, ways, alleys, and places in the
C~ty of Santa Monica to the Southern California Gas Company.
SECTION 2. That said franchise is proposed to be
granted for an lndeterminate term, pursuant to Sect10n 6264
of the Public Utilit1es Code of the State of Callfornia and
Sect10n 1602 of the Clty Charter of the City of Santa Monica.
SECTION 3. That OctOber 10, 1918i ,at- 1:30 o'clock
p.m., at the Santa Monica C~ty Council Chambers is the place
and time hereby fixed for a hearlng on said proposed granted
franchise whereat any persons having an interest therein or any
obJection to the. granting thereof may appear before the C1ty
Councl1 and be heard thereon (the tlme so fixed for such hearing
belng not less than twenty (20) nor ~ore than Slxty (60) days
after the date aX the passage of th~s Resolution).
SECTION 4. That the appllcation for said franchlse
states, and Southern California Gas Company, its successors
and assigns wl11, if the franchise is granted, during the
life of said franchise, pay to the City of Santa Monica, two
(2%1 percent of the gross annual receipts of Southern California
Gas Company arising from the use, operation or possession of
said franchise; provided, however, that such payment shall in
no event be less than one (1%) percent of the gross annual
rece~pts of Southern Californla Gas Company, its successors
and ass~gns, derived from the sale of gas w~thin the limits
