IN REGARD 10 1HZ REGUlATIONS FUR USING 'lHE SAME AND 'IRE CHARGmG OF FEES FOR USING THE SAME. llliEREAS, in determining policy in regard to the use of the pvPli~ recreation facilities and the services of the Recreation and Parks Department of the City of Santa ~ica, evaluation should be based on social criteria and not on econanic criteria, and WHEREAS, the facilities of the Recreation and Parks Department are primarily for the use of the public; and WHEREAS, public recreation services should be available to all people without discrimination as to race, religion, sex, or ecananic status; and 'WHEREAS, the recreational program should include a wide variety of activities to appeal to different interests, ages) and abilities and not be limited merely to physical activities, outdoor activities, daytime activities, or to children or others of special categories; and 1;.JHEREAS, traditional recreation programs include sane activities that entail expense beyond the normal cost of activities in the general program, and WHEREAS, the manbers of the public are entitled to have those making use of a limited public facility pay their just share of the cost of operating, mamtaining and constructing such facilities, NOW, nIEREFORE, 'mE CITY OOUNCIL OF THE CITY OF SANTA MJNICA. OOES RESOLVE AS FOI.1.CXtJS sllA The .owing factors shall be cansidA in aging fees for the use of recreational facilities in the City of Santa l-bnica: A. A registration charge shall be made for activities provided by the department as part of its program for children and youths, and for specialized activities such as swinming, Im.lSic, or specialized instnlctions, and for expenr1.::able materials used in programs such as craft programs. B. Fees shall be charged and assessed for use of recreational facilities when : (1) The particular service is relatively costly to render. (2) The particular service is dananded by ca:nparatively few persons and the cost of providing the facilities therefore is relatively high. (3) t-Vhen the service is primarily for adults. (4) When the service is enjoyed by a majority of non-residents who are not taxpayers of the local jurisdiction. (5) {.fuen the activity is non-recreational or is limited to private or exclusive group~ aa in such instances the Recreation and Parks Department frequently is in ccrnpetition with private and carrne.rcial agencies which have bUllt facilities to meet the dEmand of this type of activity. (6) The schedule of fees shall be set according to accessibility, conditions, and current costs for the maintenance and upkeep of the facilities <,md the City overhead factor. (7) Fixed fees established by this resolution shall be adjusted armually by the Consuner Price Index., April to April for the los Angeles area. C. General recreation programs, aquatic events, termis, table tennis, volley- ball, touch football, track and field, gymnastics, and othe team and individual contests, the fees shall be detennined by the Recreation and Parks Department and shall be based upon the cost of providing recognition to participants, services, facilities provided and material consuned. and the City overhead factor. -2- .e e - e D. Definitions : (1) Resident Adult Groups. The resident fees shown shall be for all religious> civic recreational, fraternal> or service organizations whose normal place of meeting, clubhouse, or other ~eting place is located in the City of Santa Monica, and by all groups in which more than 50 percent of the persons using the facilities are residents of the City of Santa MJn~ca. (2) ~.sident Youth Groups. The resident fee sh(l'l;.vn shall be for all religious, civic, recreational, fraternal, or service organizations serving youth 17 years of age and under, whose nonnal place of meeting, clubhouse, or other meeting place is located in the City of Santa M:lmca, and to all groups which IOClre than fifty percent of the persons using the facilities are residents of the City of Santa Monica. (3) Non-Resident ~ult and You~ Groups. All groups not qualified by the above definition shall pay the non-resident fee. SECTICN 2. The following fees are established for the use of the facilities of the Recreation and Parks Depad,:t:uent, except for the taking of pictures for CUli\:1ercial purposes. The fees shall be adjusted armually for the period of July 1 to June 30. A. B~ilding Rentfll. The rental fee for all buildings by resident groups will be based upon the cost per square foot to maintain the building. In addition, a City over- head factor will be added. Pennits \.n.ll be granted In a minimun two hour time block. A non-resident surcharge of 25/0 will be added. (1) Private of Benefit Groups, the fee shall be $150.00 for each two hour period. B. Ri~le. Range. (4) Re.sident Youth Groups. Fee shall be based upon hourly maintenance and operations costs, plus the total City costs associated with the Recreation and Parks Department representative at a two hour minirnun rate. (5) Private or benefit groups. Resident fee shall be $250.00 for the first four hour period and $25.00 for each additional hour. Non-resident fee shall be $260 00 for the first four hour period and $35.00 for each additional hour. (6) Seasonal rates for each of two seasons of recreational swimning shall be established as follows: One season 'shall be iran June 16 through September 15, and the other season shall be fran Septanber 16 through June 15. (b) Public Groups - Base rate of $25.00 per day, plus 20% of gross incane over $100.00 (c) Private or Coomercial Groups - Base rate of $50.00 per day, plus 25% of gross income over $100.00. D. Adult Special Instruction. All instructors salaries and administrative expenses shall be met by the fee. All participants shall pay for all materials used in the program activities. E, Municipal Sports. The fees charged for munic~pal sport leagues shall cover all costs for materials, officials, building rentals, lights, trophies and the city overhead factor. (1) Athletic Fields - The rental of athletic fields by adult groups will be based upon the cost of maintenance and for night use the kilowatt charge per hour. In addition the city overhead factor will be added. Pennits will be granted in a mininn.m twO hour time block. A non-resident surcharge of 25% will be added. (2) Lawn Bowling Green Fee (a) $30.00 per year per person, or $10.00 for each three months. (4) \.Jhether sections of bleachers are available for use shall be detennined by the Recreation and Parks Director. (5) Schools within either of the Santa Monica School Districts and the Chamber of Cu::werce of Santa M:mica may use the bleachers without cost. if all work of taking down, IOOVi.ng. setting up, and retmning the bleachers is done by other than City t:!_uployees and no City equipment is used -6- . . .e e e - H. ~y Tots (1) A fee of $7.00 for residents and $10.00 for non-res~dents shall be charged for each child attending a series of ten sessions, or anyone of such sessions. I. Ternris Court Reservation Rates. A. Uncoln Park, Santa Nonica High School, Santa l-mica College courts are reserved. (1) Hourly rates (payable in advance). Adults 18 and over: $1. 00 per hour per court. (2) Quarterly pass rates. (Payable in advance). January 2, April 1, July I, October 1st. Adults under 62 years of age - $11.00 Adults 62 years and older 5.00 Jnniors 17 and under 5 . 00 (3) Hours of reservations to be detennined by Recreation and Parks Director. SECI10N 3. u."'il,.:>rcial Enterprise Groups and! or Profit l-Jaking Groups: A. CUlliercial enterprise groups and/or profit making groups shall be pemitted use of the facilities only upon such tenns and conditions as may be provided by agreanents executed between such groups and the City, after public bearings by the Recreation and Parks Conmissian upon application for the group, unless such special hearing be waived by the Cu.unission. Fees shall be paid by ~rcial enterprise or profit making groups, in accordance with agreement between such group and the City. SEcnCN 4.
