RESOLUTION NO, 5157 (CCS)
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA CONFIRMING THE REPORT OF THE SUPERIN-
TENDENT OF STREETS REGARDING TREE PLANTING DISTRICTS
NO, 3 and 4.
WHEREAS, the City Council of the City of Santa Monica, pursuant
to Section 5870, et seq.s of the Streets and Highways Code, commended
proceedings to cause the planting of trees on L1ncoln Boulevard between
Broadway and Wilshire Blvd., and between Pica and Pacific Street in the
City of Santa ~IDnicas and
WHEREAS, a public hearing was held on said matters, and there-
after said City Council ordered said planting to be accomplished; and
WHEREASs sixty (60) days after said order was served, the work
had not been completed by the owners or persons in possession of the
affected properties, and the Superintendent of Streets caused the work to
be done; and
WHEREAS, the Superintendent of Streets did file with the City
Council of the City of Santa Monica his reports of such works and a hearing
thereon was called by Resolution No. 5145 (C.C.S.); and
WHEREAS, the City Council conducted a noticed hearing to
consider any protests or objections to the Reports of the Work.
NOWs THEREFOREs THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Reports of Work of the Superintendent of
Streets heretofore filed and above describeds be and the same is hereby
confirmed.

SECTION 2. That all of said protests and objections of every
kind and nature to the planting or to the assessments and all appeals
therefrom to said City Council be and the same hereby are overruled and
denied.
SECTION 3. That the cost of the planting, as set forth in said
Reportss shall be assessed agalnst the properties herein describeds which
properties front upon the improvements so planted.
SECTION 4. That if such assessment is not paid within the
t1me permitted by law the same shall constitute a special assessment and
lien against the properties therein describeds in the amount set forth in
said Reports, which lien shall continue until the assessment and all
interest thereon is paid.
SECTION 5. That if the assessment is not paid within the time
permitteds the City Clerk shall deliver a Notice of Lien, signed by the
Superintendent of Streetss as provided in Section 5891 of the Streets and
Highways Code of the State of Californias to the County Assessor and Tax
Collector, whos in accordance with applicable laws shall collect said
assessment, together with all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the adoption
of this Resolution,
