RESOLUTION NO. 7014 (CCS)

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-85-62)
WHEREAS, the Street Super1ntendent of the CIty of Santa
MonIca, pursuant to SectIon 5600 to 5630 of the Streets and HIghways
Code, commenced proceedlngs to cause the repa1r of damaged sIdewalks,
driveways a~d curbs In the Clty of Santa Monica at 1115 PrInceton,
1023 Maple, 1507 Maple, 922 San VInce~te, 475 23rd, 402 23rd, 376
23rd, 201 2y'd, 1047 4th, 501 23rd, and 476 23rd all wlthln the CIty
of Santa Monlca.
WHEREAS, S1Xty days after sald order was served, the work had
not been completed by the owners or persons In possession of the
affected propertIes, and the SuperIntendent of Streets caused the work
to be done; and
WHEREAS, the SuperIntendent of Streets gave the notIce
reqUIred by SectIon 5616 of the Streets and Highways Code; and
WHEREAS, the Super1ntendent of Streets d1d f11e with the C1ty
Councll of the CIty of Santa MonIca hIS report of repaIrs and cost as
requlred by SectIon 5617 of the Streets and HIghways Code; and

WHEREAS, upon the day and hour f1xed for hear1ng by Resolution
Number 6997 (eeS) , the Clty Councll of the City of Santa MODIca heard
and passed upon the report of the SuperInte~dent of Streets together
with all ObjectIons and protests as required by Section 5618 of the
Streets and Hlghways Code;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of Streets
heretofore fl1ed and above-descr1bed be and the same is hereby
confirmed.
SECTION 2. That all protests and object1ons of every kind and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denled.
SECTION 3. That the cost of the repairs, as set forth in the
report of the Superlntendent of Streets, shall be assessed against the
propert1es therein described, wnich propertles front upon the sidewalk
upon WhlCh the repalrs were made.
SECTION 4. That 1f such assessment 1S not paid within the
t1me permitted by law, the same shall constltute a special assessment
aga1nst and lien on the properties therein described, in the amount
set forth in the report ef the Super1ntendent af Streets, which lien
shall cont1nue until the assessment and all interest thereon 1S paid
or unt11 it 1S dlscharged of record.
SECTION 5. That lf the assessment is not pald w1thin the time
perm1tted by law, the Superintendent of Streets, in accordance with
Section 5628 of the Streets and Highways Code, shall dellver a Notice
of L1en, prepared 1n the manner requ1red by Section 5626 of the
Streets and H1ghways Code, to the County Auditor who shall collect the
assessment together w1th all other taxes aga1nst the property.

SECTION 6. That the Clty Clerk shall certlfy to the adoption
of this resolution and thenceforth and thereafter the same shall be 1n
full force and effect.
