RESOLUTION NO. 7015(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING GUTTER CONSTRUCTION AND STREET
RESURFACING ON VARIOUS CITY STREETS
WHEREASt the Street Superintendent of the City of Santa
Monlca, pursuant to Section 5810 et seq. of the Streets amd
Hlghways Code, commenced proceedIngs to cause gutter canstructlon
and street resurfacing on:
Euc11d between WilshIre and 150 feet south of Wilshlre
Eucl1.d between Santa Morllca and 250 feet north of Santa
Monica
Ashland between Maln and 100 feet east of Ma1n
Berkeley between Nebraska and Pennsylvan1a
Berkeley between 161 feet north of Wilshire and 150 feet
south of Wilshire
Eleventh between Pico and 17 feet north ef Pico on the
westerly Slde
Ozone between L1ncoln and 87 feet east of L1ncoln
Third Street between Wllshire and 100 feet north of Wllshlre
Fourth Street between W1lshlre and 100 feet north of Wilshlre
WHEREAS, the SuperIntendent of Streets served the notice
requIred by Sect10n 5816 of the Streets and Highways Code and the
City CouncIl of the C1ty of Santa Mon1ca held the hearIng
requ1red by SectIon 5878.1 of the Streets and H1ghways Code; and
WHEREAS, Slxty (60) days after the notlce was served, the
work had not been completed by the owners or persons in
possesslon of the affected properties, and the Superintendent of
Streets caused the work to be done; and
WHEREASt the Super Hltendent of Streets gave the notice
requIred by Sect10n 5881 of the Streets and Highways Codej and

WHEREAS, the Superintendent of Streets did fIle with the
City Councll ef the City of Santa Monica hIS report of
constructIon and cost as required by SectIon 5882 of the Streets
and Highways Code; and
WHEREAS, upon the day and hour f1xed for hearlng by
ResolutIon Number 6996 (CCS), the CIty CouncIl of the Clty of
Santa MonIca heard and passed upon the report of the
Super1ntendent of Streets together with all objections and
protests as requ1red by Sect10n 5883 of the Streets and Highways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Super1ntendent of
Streets heretofore filed and above-described be and the same is
hereby confIrmed.
SECTION 2. That all protests and obJectIons of every kind
and nature to the report of the SuperIntendent of Streets be and
the same are hereby overruled and den1ed.
SECTION 3. That the cost of construct1on, as set forth in
the report of the SuperIntendent of Streets, shall be assessed
againist the properties therein descrIbed, WhiCh properties front
upon the gutters and resurfaced streets so constructed.
SECTION 4. That if such assessment is not paid withIn the
time permitted by law, the same shall constitute a special
assessment against and lien on the properties thereln described,
in the amount set forth in the report of the Superintendent of

Streets, Whlch lien shall contlnue until the assessment and all
interest thereon 1S pald or until 1t 1S dlscharged of record.
SECTION 5. That if the assessment 1S not pa1d wlthin the
t1me permltted by law, the Superlntendent of Streets, in
accordance with Section 5893 of the Streets and Hlghways Code,
shall deliver a Notlce If Lien, prepared in the manner requ1red
by Section 5891 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together with all other
taxes against the property.
SECTION 6. That the CIty Clerk shall certify to the
adopt1on of this resolut1on and thenceforth and thereafter the
same shall be In full force and effect.
