RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINrENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-85-64)
WHEREAS, the Street Superintendent of the CIty of Santa
Mon1ca, pursuant to Sect10n 5600 to 5630 of the Streets and Highways
Code, commenced proceed1ngs to cause the repa1r of damaged SIdewalkS,
driveways and curbs ln the City of Santa MonIca at 1315 Georgina, 1043
Prlnceton, 938 2 nd St., 312 24th St., 609 24th St., 1146 24th St.,
l434 24th St., l433 24th St., 1218 I1tn St., 311 24th St., 303 24th
St. , 912 Ml.chlgan, 913 MiChigan, 1142 24th St., and 445 24th St., all
wlthln the CIty of Santa Monlca
WHEREAS, SIxty days after sal.d order was served, the work had
not been completed by the owners or persons in possesslon of the
affected propertIes, and the SuperIntendent of Stre~t5 caused the work
to be done; and
WHEREAS, the SuperIntendent of Streets gave the notlce
required by Section 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets dId file with the Clty
CounCl.l of the Cl.ty of Santa Mon1ca hIS report of repa1rs and cost as
requlred by SectIon 5617 of the Streets and Hlghways Code; and
WHEREAS, upon the day and hour fixed for hearing by ResolutIon
Number 7013 ( CcS) , the CIty CounCIl of the Clty of Santa Monica heard
and passed upon the report of the Superintendent of Streets together
WIth all ObjectIons and protests as required by Sectlon 5618 of the
Streets and HIghways Code;

NOW, THEREFORE, THE CIry COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION l. That the report of the Superlntendent of Streets
heretofore filed and above-descrlbed be and the same IS hereby
confIrmed.
SECTION 2. That all protests and obJectlons of every klnd and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denled.
SECTION 3. That the cost of the repalrs, as set forth ln the
report of the Superlntendent of Streets, shall be assessed against the
propertles thereIn described, WhlCh propertIes front upon the sidewalk
upon WhlCh the repalrs were made.
SECTION 4. That if such assessment 15 not pald within the
t1me permItted by law, toe same shall constltute a specIal assessment
agaInst and llen on the propert1es therein descrIbed, in the amount
set forth 1n the report of the Superlntendent of Streets, which llen
shall contlnue until the assessment and all interest thereon is pald
or until it is dIscharged of record.
SECTION 5. That If the assessment IS not paId wlth1n the tIme
permItted by law, the Superlntendent of Streets, 1.n accordance wlth
Section 5628 of the Streets and Highways Code, shall delIver a NotIce
of Lien, prepared In the manner requIred by SectIon 5626 of the
Streets and H1.ghways Code, to the County Audltor who shall collect the
assessment together wlth all other taxes against the property.

SECTION 6. That the C1ty Clerk shall certify to the adopt1on
of th1S resolutlon and thenceforth and thereafter the same shall be ln
full force and effect.
