RESOLUTION OF THE CITY COU~CIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEwAYS AND CURBS (SR-85-66)
WHEREAS, the Street Super1ntendent of the CIty of Santa
Mon1ca, pursuant to Section 5600 to 5630 of the Streets and Highways
Code, commenced proceedings to cause the repair of damaged sidewalks,
driveways and curbs 1n the City of Santa Mon1ca at 478 24th St., 256
24th St., 1205 Pine, 504 24th St., l826 Ca11fornia, 604 24th St., l811
Ca11forn1a, 250 25th St., 209 25th St., 201 25th St., 715 24th St.,
and 1736 Franklin St.
WHEREAS, S1xty days after saId order was served, the work had
not been completed by the owners or persons in possession of the
affected properties, and the Super1ntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
requIred by Sect10n 5616 of the Streets and Highways Code; and
WHEREAS, the SuperIntendent of Streets did file wlth the CIty
Counc11 of the CIty of Santa Mon1ca his report of repaIrs and cost as
requIred by Sect10n 5617 of the Streets and Highways Code; and
WHEREAS, upon the day and hour flxed for hearing by Resolution
Number 7030 ( ccs ) , the City Councll of the C1ty of Santa Monlca heard
and passed upon the report of the SuperIntendent of Streets together
with all objections and protests as required by Section 5618 of the
Streets and Highways Code;

NOw, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOwS:
SECTION l. The report of the SuperIntendent of Streets
heretofore filed and above-descr~bed be and the same is hereby
conf~rmed.
SECTION 2. All protests and objections of every k1nd and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and den1ed.
SECTION 3. The cost of the repairs, as set forth in the
report of the Superintendent of Streets, shall be assessed against the
properties therein descr1bed, which properties front upon the sidewalk
upon Wh1Ch the repairs were made.
SECTION 4. If such assessment ~s not pa1d within the time
permItted by law, the same shall constitute a spec1al assessment
aga1nst and lIen on the properties therein described, 1n the amount
set forth 1n the report of the Superintendent of Streets, WhlCh lien
shall cont1nue unt11 the assessment and all interest thereon ~s pa id
or untll 1t is dlscharged of record.
SECTION 5. If the assessment is not paid within the time
permItted by law, the Super1ntendent of Streets, in accordance with
Section 5628 of the Streets and H1ghways Code, shall deliver a Notlce
of Lien, prepared 1n the manner requlred by Section 5626 of the
Streets and Highways COde, to the County Auditor who shall collect the
assessment together with all other taxes agalnst the property.

SECTION 6. The City Clerk shall certLfy to the adoption of
thIS resolutLon and thenceforth and thereafter the same shall be In
full force and effect.
