RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEwAYS AND CURBS (SR-85-65)
WHEREAS, the Street SuperIntendent of the Clty of Santa
MonIca, pursuant to Sectlon 5600 to 5630 of the Streets and Hlghways
Code, commenced proceedlngs to cause the repalr of damaged sidewalks,
driveways and curbs in the Clty of Santa Monlca at 1708 Robson, 1714
Robson, 1718 Robson, 1730-42 Robson, 1743 RObson, 1737 Robson, l727
Robson, 1723 Robson, l733 Robson, 1717 Robson, and l713 Robson, all
withln the City of Santa MonIca
WHEREAS, SIxty days after sald order was served, the wor k had
not been completed by the owners or persons In possession of the
affected propertles, and the Superlntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
requlred by SectIon 5616 of the Streets and Hlghways Code; and
WHEREAS, the SuperIntendent of Streets did file with the Clty
CouncIl of the CIty of Santa MonIca hlS report of repalrs and cost as
requlred by Sectlon 5617 of the Streets and HIghways Code; and
WHEREAS, upon the day and hour fixed for hearlng by Resolution
Number 7042 (CCS), the Clty Council of the City of Santa Monica heard
and passed upon the report of the Superlntendent of Streets together
with all obJectIons and protests as requlred by Sectlon 5618 of the
Streets and HIghways Code;

NOW, THEREFORE, THE Clry COUNCIL OF THE CI'rY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION l. That the report of the Superintendent of Streets
heretofore fIled and above-descrIbed be and the same is hereby
confirmed.
SECTION 2. That all protests and objectIons of every kind and
nature to the report of the Superlntendent of Streets be and the same
are hereby overruled and denled.
SECTION 3. That the cost of the repairs, as set forth in the
report of the Superlntendent of Streets, shall be assessed agalnst the
propertles thereln descrlbed, which propertles front upon the sidewalk
upon WhlCh the repalrs were made.
SECTION 4. That If such assessment is not paid within the
time perml tted by law, the same shall constitute a speclal assessment
agalnst and llen on the propertIes thereln described, ln the amount
set forth in the report of the Superintendent of Streets, which lien

shall contInue until the assessment and all interest thereon lS pald
or untl1 It 1S dlscharged of record.
SECTION 5. That if the assessment is not paId wlthln the time
permltted by law, the Superintendent of Streets, ln accordance with
Section 5628 of the Streets and Hlgnways Code, shall dellver a Notice
of LIen, prepared ln the manner required by Section 5626 of the
Streets and Highways Code, to the County Auditor who shall collect the
assessment together wlth all other taxes against the property.

SECTION 6. Tnat the CJ.ty Clerk shall certify to the adoptlon
of thIS resolution and thenceforth and thereafter the same shall be in
full force and effect.
