RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (5R-85-67)
WHEREAS, the Street Superlntendent of the City of Santa
Monica, pursuant to Sect~on 5600 to 5630 of tne Streets and HIghways
Code, commenced proceedIngs to cause the repaIr of damaged sidewalks,
drlveways and curbs ln the Clty of Santa Monica at lOl2 2nd St., 305
Pa11sades Avenue, 1419 lOth St., 170l Ca11fornia Ave., l730 Ca1ifornla
Ave. , l025 Plne St., 2323 La Mesa Dr., l029 2nd St., 1531 Georglna
Ave. , and 2603 22nd St., all withln the C~ty of Santa Monica; and
WHEREAS, sixty days after sald order was served, the work had
not been completed by the owners or persons in posseSS10n of the
affected properties, and the SuperIntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the not~ce
requlred by SectIon 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets dld f~le with the Clty
Councll of the CIty of Santa Monlca his report of repalrs and cost as
requlred by Section 5617 of the Stre~ts and Hlghways Code; and
WHEREAS, upon the day and hour flxed for hearIng by Resolutlon
Number 7039 ( CCS ) , the Clty Council of the City of Santa Monica heard
and passed upon the report of the Super~ntendent of Streets together
wIth all object~ons and protests as requlred by Sectlon 5618 of the
Streets and Highways Code;

NOW, THEREFORE, 'rHE CITY COUNC IL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Super1ntendent of Streets
heretofore f11ed and above-descrIbed be and the same 1S hereby
conf1rmed.
SECTION 2. That all protests and ob]ect1ons of every kind and
nature to the report of the Super1ntendent of Streets be and the same
are hereby overruled and den1ed.
SECTION 3. That the cost of the repaIrs, as set forth In the
report of the Superlntendent of Streets, shall be assessed against the
propert1es thereIn descrIbed, which properties front upon the sldewalk
upon wh1ch the repa1rs were made.
SECTION 4. That If such assessment 1S not pa1d within the
t1me permitted by law, the same shall const1tute a specIal assessment
agaInst and lien on the propertIes therein described, 1n the amount
set forth In the report of the Superintendent of Streets, which lien
shall cont1nue until the assessment and all 1nterest thereon is paId
or until 1t is dIscharged of record.
SECTION 5. That If the assessment IS not pa1d with1n the time
permitted by law, the SuperIntendent of Streets, 1n accordance with
SectIon 5628 of the Streets and HIghways Code, shall del1ver a Notice
of Lien, prepared In the manner reqUIred by Section 5626 of the
Streets and Highways COde, to the County AudItor who shall collect the
assessment together with all other taxes agaInst the property.

SECTION 6. That the CIty Clerk shall certify to the adopt1.on
of this resolut1.on and thenceforth and thereafter the same shall be in
full force and effect.
