A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA OF ITS INTENTION
TO M1END THE ZONING CODE SECTION
REGARDING DEMOLITIO~ OF BUILDING AND STRUCTURES
SECTION 1. Pursuant to Santa Monica Municlpal Code Sect10n
9149, the C1ty Council does hereby give notice of its intent10n
to in1tiate proceed1ngs to amend Section 9123 of the Municipal
Code to change the text as follows:
( I) Demol1tlons of buildlngs and structures shall be
perm1tted when all of the follow1ng conditions have been met:
( a) A removal perm1t has been granted by the Rent Control
Board when required.
(b) The final permit for a replacement proJect has been
lssued or the D1rector of Plannlng and the Buildlng Officer have
determ1ned that the existing structure 1S a public nUlsance.
(c) A property malntenance plan has been approved by the
Director of Plannlng and Buildlng Off1cer. The Architectural
Review Board shall adopt and the Planning Commission shall approve
guidelines and standards for property ma1ntenance plans pursuant
to Santa Monica Mun1c1pal Code Section 9503B.
( d) Subsequent development 1S 1n conformlty with the General
Plan and all other appl1ca~le regulat1ons.
(2 ) Non-controlled single-family residentlal units are

exempt from these requlrements except that a property malntenance
plan approved by the Director of Plannlng and the BUllding
Offlcer is required as provided for in l(c) above.
SECTION 2. l'Ji thin 30 days from the adoptlon of this
resolution, the Planning Commission shall conduct a public
hearing on thlS matter and wlthln 40 days from the adoption of
thJ.s resolutlon the Planning commlssion shall make its findlngs
and recommendations to the clty CouncJ.l.
SECTION 3. The Clty Clerk shall certify to the adoptlon
of thlS Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
