RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMI~G THE REPORT OF THE SUPERI~TENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEwAYS AND CURBS (SR-85-68)
WHEREAS, the Street Super1ntendent of tne C1ty of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and H1ghways
Code, commenced proceed1ngs to cause the repair of damaged sidewalks,
dr1veways and curbs 1n the C1ty of Santa Mon1ca at 2634 3rd St., 2628
3rd St., 2936 Ma1n St., 836 Ashland Ave., 2216 Ma1n St., 1047 Ocean
Park Blvd., 3009 2nd St, 3011 2nd St., 830 Maple St., 2519-2525 10th
St., 1918 Ma1n St., 2627 L1ncoln Blvd., 2721 6th St., 2727 6th St.,
2200 Ma1n St., 1018 Grant St., and 2912 3rd St.
WHEREAS, sixty days after sa1d order was served, the work had
not been completed by the owners or persons 1n possess1on of the
affected propert1es, and the Super1ntendent of Streets caused the work
to be done: and
WHEREAS, the Superintendent of Streets gave the not1ce
requ1red by Section 5616 of the Streets and Highways Code: and
WHEREAS, the Super1ntendent of Streets did f11e w1th the City
Counc11 of the C1ty of Santa Monica his report of repairs and cost as
requ1red by Section 5617 of the Streets and Highways Code: and
WHEREAS, upon the day and hour fixed for hear1ng by Resolution
Number 7U44 ( CCS ) , the C1ty Counc11 of the CIty of Santa Monica heard
and passed upon the report of the Super1ntendent of Streets together
w1th all ObJections and protests as requ1red by Section 5618 of the
Streets and H1ghways Code:

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1.. The report of the Superintendent of Streets
heretofore flIed and above-described be and the same 1S hereby
confirmed..
SECTION 2.. All protests and obJections of every k1nd and
nature to the report of the Super1ntendent of Streets be and the same
are hereby overruled and denied..
SECTION 3.. The cost of the repa1rs, as set forth in the
report of the Superlntendent of Streets, shall be assessed aga1nst the
properties therein described, which propert1es front upon the sldewalk
upon which the repairs were made..
SECTION 4.. If such assessment IS not paId Wlth1n the time
permitted by law, the same sh a 11 constitute a special assessment
aga1nst and lien on the properties therein descr1bed, 1n the amount
set forth in the report of the Superintendent of Streets, which lien
shall cont1nue unt11 the assessment and all interest thereon is paid
or untIl 1t 1S discharged of record.
SECTION 5. If the assessment is not paid wIthIn the tIme
permItted by law, the Superintendent of Streets, in accordance wIth
SectIon 5628 of the Streets and H1ghways Code, shall deliver a NotIce
of Lien, prepared 1n the manner requIred by SectIon 5626 of the
Streets and Highways Code, to the County Auditor who shall collect the
assessment together wIth all other taxes aga1nst the property.

SECTION 6, The City Clerk shall cert~fy to the adoption of
this resolution and thenceforth and thereafter the same shall be ln
full force and effect.
