R-7083 . . . e RESOLUTION NO. 7083(CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA FINDING THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE CONSTRUCTION OF STREET LIGHTING AND ORDERING WORK ON BERKELEY AND 14th STREETS BETWEEN SANTA MONICA AND WILSHIRE BOULEVARDS, 26th STREET FROM PICO BOULEVARD TO PEARL STREET, AND CALIFORNIA , AVENUE BETWEEN 18th AND 20th STREETS, ALL WITHIN THE CITY OF SANTA MONICA, IN ACCORDANCE WITH RESOLUTION OF INTENTION 7065 (CITY COUNCIL SERIES) WHEREAS, the Clty Councll of the Clty of Santa Monlca, on the 13th day of August, 1985, passed and adopted lts Resolutlon of Intentlon, being Resolutlon No. 7065 (eCS), declarlng its inte~tlon to order the work descrlbed thereln to be done, whlCh said Resolutlon of Intentlon duly and legally was pUbllshed as requlred by law and notlce of sald improvement has been given 1n the manner requlred by law and all wrItten objections and protests to the proposed work or the extent of the district to be assessed were heard and considered by the Clty CouncIl; and WHEREAS, a publlc hearlng has been held duly and regularly pursuant to Resolutlon 7065 (CCS) and the laws and Constitution of the State of Callfornia on the proposed constructlon of street llghtlng and appurtenant work thereto, as described in the Resolution of Intentlon No. 7065 (CCS) , on Berkeley and 14th Streets between Santa Monlca and Wilshire Boulevards, 26th Street from Pico Boulevard to Pearl Street, and Callfornia Avenue between 18th and 20th Streets; and WHEREAS, sald improvement has been considered fully, ------------------ . . . e NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1- The publIC Interest and CJonvenlence requIre, and the City CouncIl of the CIty of Santa MonIca hereby orders, the work desCJrlbed In saId Resolution of IntentIon to be done on Berkeley and 14th Streets between Santa MoniCJa and Wilshire Boulevards, 26th Street from Pleo Boulevard to Pearl Street, and CalifornIa Avenue between 18th and 20th Streets, all wIthin the - CIty of Santa MonICJa. Any and all of said protests and obJeCJtions of every kInd and nat ur e to the proposed work or to the extent of the dIstrIct to be assessed be and the same hereby are overruled and denied. SECTION 2. The City CounCJil hereby finds and determInes further that "Special Assessment InvestIgatIon, LimItation and MaJorIty Protest Act of 1931" shall not apply to the making of saId lmprovement. SECTION 3. The Improvements shall be conducted under the Improvement Act of 191 1 J WhICh IS Division 7 of the Streets and Hlghway Code of the State of CalIfornIa, and the Street SuperIntendent and the CIty Attorney presented to the saId CIty Council the ResolutIon of Intention requIred by said Improvement Act to InitIate the proceedIngs for said Improvement. ---------------- -----~~~------~-- - . . e SECTION 4. The CIty Clerk hereby is directed to post a notIce for fIve days on or near the door of the Council Chambers of the City Hall InvIting sealed proposals or bids for doing the work ordered and referring to the specIfIcations on file and to publish a notIce InVIting such proposals for two days In the Evening Outlook, a newspaper published and cIrculated in saId CIty. SECTION 5. Reference hereby is made to said Resolution of Intention for a descrIption of the work, the assessment district, the bonds to be issued and for further particulars. SECTION 6. The CIty Clerk shall certIfy to the adoption of this ResolutIon, and thenceforth and thereafter the same shall be in full force and effect.
