RESOLUTION NO. 7085(CCS)

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-85-70)
WHEREAS, the Street Superlntendent of the City of Santa
Monlca, pursuant to Section 5600 to 5630 of the Streets and Highways
Code, commenced proceedIngs to cause the repair of damaged sidewalks,
driveways and curbs in the CIty of Santa MonIca at 1205 Grant St.,
1002 PICO Blvdw, 833 Pearl Stw, 829 Maple St., 1221 Grant St., 1201
Grant St., 1714 Sunset Ave., 1703 Maple St., 1420 Maple Stw, 141-8
Maple St., 1402 Maple St.., 2627 11th St., 2222 16th St., 1211 Grant
St. , 860 PICa Blvd.., 833 Maple Stw, and
WHEREAS, Slxty days after saId order was served, the work had
not been completed by the owners or persons in possession of the
affected properties, and the Superintendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
requIred by Section 5616 of the Streets and Highways Code; and
WHEREAS, the SuperIntendent of Streets dId fIle wIth the City
CouncIl of the CIty of Santa MonIca hIS report of repaIrs and cost as
required by Sectlon 5617 of the Streets and HIghways Code; and
WHEREAS, upon the day and hour fIxed for hearing by ResolutIon
Number 7067 ( CCS ) , the CIty Councll of the City of Santa MonIca heard
and passed upon the report of the Superintendent of Streets together
with all obJectIons and protests as required by Section 5618 of the
Streets and HIghways Code;

NOW, 'rflEREFORE, TrlE CI'fY cour~c IL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOwS:
SECTION 1- The report of the Super1ntendent of Streets
heretofore fl.led and above-descrl.bed be and the same 1S hereby
conflrmedv
SECTION 2v All protests and obJections of every k1nd and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and deniedv
SECTION 3v The cost of the repa1rs, as set forth 1n the
report of the Super1ntendent of Streets, shall be assessed aga1nst the
propertIes there1n described, which propertl.es front upon the sldewalk
upon Wh1Ch the repa1rs were madev
SECTION 4. If such assessment 1S not paid w1th1n the time
perml.tted by law, the same shall constl.tute a special assessment
aga1nst and l1en on the propert1es there1n described, 1n the amount
set forth 1n the report of the Super1ntendent of Streets, Wh1Ch llen
shall cont1nue untll the assessment and all 1nterest thereon 1S pa1d
or until 1t 1S d1scharged of recordv
SECTION 5v If the assessment 1S not pa1d w1th1n the time
perm1tted by law, the Super1ntendent of Streets, in accordance with
Sect10n 5628 of the Streets and H1ghways Code, shall deliver a Notice
of Lien, prepared 1n the manner required by Sect10n 5626 of the
Streets and Hlghways Code, to the County Auditor who shall collect the
assessment together with all other taxes against the propertyv

SECTION 6.. The City Clerk shall certlfy to the adoptlon of
this resolutIon and thenceforth and thereafter the same shall be in
full force and effect.
