R-7087 '" - - tI RESOLUTION NO. 708,7 (,CCS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA WAIVING ADVERTISEMENT REQUIREMENTS AND AUTHORIZING THE SALE OF A PARCEL OF PROPERTY LOCATED ADJACENT TO 1723 CLOVERFIELD BOULEVARD AND DIRECTING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO COMPLETE ... THE SALE WHEREAS, the City af Santa MonIca acquIred the property described 1n Section 2 of th1S Resolution in November of 1958 for the purpose af extendIng Twenty SIXth Street from Colorado Boulevard to Cloverfield; and the use of the property hereunder descrIbed; and WHEREAS, staff has determIned that the property described in Section 2 of this Resolution IS no longer needed for the purpose acquired and that saId property IS not needed for any publIC purpose; and WHEREAS, the CIty has receIved an offer to purchase the property described in Section 2 of thIS ResolutIon at Its highest use, which is in connection WIth adJacent property, such offer beIng $220,000 from a Mr. George HumIston; and WHEREAS, pursuant to MuniCIpal Code SectIon 2508A, real property may be sold without advertIsing for bids If the City Counc il, by resolutIon adopted by at least fIve affIrmative votes, determInes that to advertise for bids would be to no avaIl and would cause unnecessary expense and delay or would not be In the best Interest of the CIty; and WHEREAS, the hIghest and only feasible use of the property IS in conJunctIon WIth the adjacent property and since the offer received by the City is from the adjacent property '- . ~ owner and to PUblicl~dvertlse the property woJlt be of no avaIl nor in the best Interest of the CIty. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SectIon 1- Public advertIsIng for bIds of the property descrIbed In SectIon 2 of thIS ResolutIon is hereby waived because to advertise for bIds would be to no avaIl and would cause unnecessary expense and delay and because It IS not in the best interests of the City. SectIon 2. SubJect to complying with all applIcable provIsions of state and local laws, the City Manager is hereby authorized to sell the certaIn real property hereafter described, to Mr. George A. Humiston for the sum of $220,000. Sald property IS described as follows: BegInnIng at the intersection of the northeasterly lIne of Cloverfield Boulevard (67 feet wide) as conveyed to the CIty of Santa MonIca by Deed recorded on 13 Apnl 1972 as instrument no. 1117 , official records of said county, wIth the northwesterly lIne of saId Lot 2; thence southeasterly along said northeasterly lIne, south 44 degrees 44 minutes 15 seconds east 43.31 feet to the true pOInt of begInnIng; thence continUIng along said line south 44 degrees 44 mInutes 15 seconds east 6.80 feet to the begInning of tangent curve concave to the north and haVIng a radius of 28.00 feet; thence easterly along saId curve through a central angle of 80 degrees 58 minutes 22 seconds an arc distance of 39.57 feet to a point of compound curvature concave to the northwest and having a radius of 270.00 feet, a radial lIne to saId pOInt bears south 35 degrees 42 minutes 37 seconds east, thence northeasterly along said curve through a central angle of 29 degrees 45 mInutes 06 seconds an arc dIstance of 140.20 feet to a point of compound curvature concave to the west and haVIng a radIUS of 769.00 feet, a radial line to saId point bears south 65 degrees 27 mInutes 43 seconds east; thence northerly along said curve through a central angle of 9 degrees 11 mInutes 45 seconds an arc distance of 123.42 feet; thence tangent to said curve north 15 degrees 20 minutes 32 seconds east 145.18 feet to the begInnIng of a tangent curve concave to the east and haVIng a radlus of 557.00 feet; thence northerly - -- . - along said cur_thrOUgh a central angle e 6 degrees 55 mInutes 51 seconds an arc distance of 67.38 feet to a pOlnt of reverse curvature concave to the west and having a radius of 543.00 feet. a radIal lIne to saId point bears south 67 degrees 43 minutes 37 seconds east; thence northerly along said curve through a central angle of 1 degrees 22 mlnutes 24 seconds an arc dIstance of 13.02 feet; thence north 74 degrees 39 mInutes 28 seconds west 11.49 feet to the westerly line of 26th Street (74 feet wide) as conveyed to the Clty of Santa Monica by said Deed recorded on 24 December 1958 as Instrument No. 1540; thence southerly along saId lIne south 15 degrees 20 minutes 32 seconds west 225.33 feet to the begInnIng of a tangent curve concave to the west and havlng a radius of 763.00 feet, said curve beIng concentrIc with saId prevlously mentioned curve having a radius of 769.00 feet; thence southerly along saId curve through a central angle of 6 degrees 16 minutes 11 seconds an arc dlstance of 83.49 feet to a llne that bears south 45 degrees 15 mHlutes 45 seconds west and passes through the true point of beginning; thence south 45 degrees 15 minutes 45 seconds west 195.47 feet to the true point of begInnIng. SectIon 3. The City Manager is instructed to execute all instruments necessary and do all other thIngs necessary to effectuate thIS sale. Section 1\ . The Clty Clerk shall certify to the adoptIon of this ResolutIon, and thenceforth and thereafter the same shall be in full force and effect.
