A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA INSTRUCTING THE SUPERINTENDENT
OF STREETS TO GIVE NOTICE TO PLANT TREES TO
PROPBRry O>\TNERS ALONG BROADwAY FROM FOURTH
STREET TO SEVENTEENTH STREET, ALL WITrlIN THE
CITY OF SANTA MONICA
WHEREAS, there lS a need to plant trees along Broadway
from Fourth Street to Seventeenth Street, all wIthIn the City of
Santa MonIca; and
WHEREAS, ln accordance wlth Section 5870 et seq. of the
Streets and Highways Code procedures eXist to notify property
owners of their duty to plant or cause to be planted trees and to
permit the SuperIntendent of Streets to plant the trees If not
planted Dr caused to be planted by the property ownerSl and
WHEREAS, the City Council of the City of Santa Monica on
Its own motlon may order the plantIng of trees;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECITON 1. Pursuant to Section 5875 of the Streets and
Highways Code, the City CouncIl of the City of Santa MonIca
orders the planting of trees along Broadway from Fourth Street to
Seventeenth.
SECTION 2. Pursuant to Sectlon 5876 of the Streets and
Highway Code, the Superintendent of Streets shall notify, in the

manner requ1red by law, the owners of property along Broadway
from Fourth Street to Seventeenth Street to plant or cause to be
planted trees. The notice shall contain the lnformat1on requ1red
by Sect10n 5879 of the Streets and H1ghways Code and shall also
spec1fy the day, hour and place, as set for th ln Section 3 of
this Resolut10n, where the C1ty Councl1 of the Clty of Santa
Mon1cd w1ll hear and pass upon ob]ect1ons or protests, 1f any,
whl.ch may be ra1sed by an property owner or other interested
persons.
SECTION 3. That pursuant to Section 5878.1 of the
Streets and Hl.ghways Code, the Clty CounC11 of the City of Santa
Monlca does hereby order and declare that on the 22 day of
October, 1985, at 7:30 p.m. , ln the Council Chambers of C1ty
Hall, 1t w111 hear and pass upon ob]ect1ons or protests, 1f any,
Wh1Ch may be ra1sed by an property owner or other 1nterested
person.
SECrrON 4. The Clty Clerk shall cert1fy to the adoption
of this resolut1on and thenceforth and thereafter the same shall
be in full force and effect.
