RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERIN~ENDENT
Of STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-85-71 )
WHEREAS, the Street Superlntendent of the Clty of Santa
Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and Hlghways
Code, commenced proceedings to cause the repalr of damaged sidewalks,
driveways and curbs ln the Clty of Santa Monica at 953 20th Street,
2222 La Mesa Drlve, 937 20th Street, 907 20th Street, 2318 Pler
Avenue, 1021 20th Street, 1015 20th Street, 941 20th Street, 933 20th
Street, 1007 20th Street, 927 20th Street, 1057 20th Street, 923 20th
Street, 919 20th Street, 913 20th Street, l027 20th Street, all wlthin
the City of Santa Monlca, and
WHEREAS, Slxty days after said order was served, the work had
not been completed by the owners or persons 1n possesslon of the
affected propertles, and the Superintendent of Streets caused the work
to be done; and
WHEREAS, the Superlntendent of Streets gave the notlce
requlred by Section 5616 of the Streets and HLghways Code; and
WHEREAS, the Superlntendent of Streets did flle with the Clty
Council of the Clty of Santa Monlca hlS report of repairs and cost as
required by Section 5617 of the Streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by Resolution
Number 7080 (CCS) , the C~ty Counc11 of the City of Santa Monica heard
and passed upon the report of the Superintendent of Streets together

wlth all obJect~ons and protests as requ~red by Section 5618 of the
Streets and Hlghways Code;
NOw, THEREFORE, THE CUY COONCIL OF THE CUY OF SANTA MONICA
DOES HEREBY ReSOLVE AS FOLLOWS:
SEc'nON 1. The report of the Superlotendent of Streets
heretofore hied and above-described be and the same is hereby
confirmed.
SECTION 2. All protests and Ob]ectlons of every k~nd and
nature to the report of the Superlntendent of Streets be and the same
are hereby overruled and den~ed.
SEc:rrON 3. 'rhe cost of toe repa1rs, as set forth ln the
report of the Super~ntendent of Streets. shall be assessed aga1nst the
properties there1n descr1bed, which propert1es front upon the sidewalk
upon which the repairs were made.
SECTION 4. If such assessment 1S not paid withln tile time
permitted by law, the same Shall constltute a speclal assessment
aga1nst and l~en on the propert1es therein descr1bed, 1n the amount
set forth in the report of the Super1ntendent of Streets, WhlCh 11en
shall cont1nue untll the assessment and all 1nterest thereon ~s pa~d
or un t 11 it is dlscharged of record.
SECTION 5. If the assessment lS not paid w1thin the time
permltted by law, the Superintendent of Streets, ~n accordance 'Inth
Sect~on 5628 of the Streets and H1ghways Code, shall del1ver a Notice
of L1en, prepared 1n the manner requ1red by Section 5626 of the
Streets and H1ghways Code, to the County Audltor who shall collect the
assessment together wlth all other taxes against the property.

SECTION 6. The City Clerk shall certl.fy to the adoption of
this resolution and thenceforth and thereafter the same shall be in
full force and effect.
