RESOLUTION OF THE CITY COUNCIL OF THE CIry OF SANTA
MONICA CONFIRMING THE REPORT OF TrlE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEwALKS,
DRIVEWAYS AND CURBS (SR-85-72 )
WHEREAS, the Street Superlntendent of the City of Santa
Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and Hlghways
Code, commenced proceedlngs to cause the repalr of damaged sidewalks,
drlveways and curbs in the Clty of Santa Monlca at 1054-60 14th
Street, 2914 washlngton Avenue, ll09 20th Street, 2221 Montana Avenue,
1111 2nd Street, 2502 Arlzona Avenue, l36 Esparta Way, l50 Esparta
Way, 260l-26lS Arlzona Avenue, 2209 Montana Avenue, IllS 20th Street,
1121 20th Street, 1127 20th Street, 1424 Broadway, 1344 4th Street,
all wlthln the Clty of Santa Monlca; and
WHEREAS, Slxty days after said order was served, the work had
not been completed by the owners or persons in possession of the
affected properties, and the Superlntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets dld file with the C1ty
Councl1 of the Clty of Santa Monlca hlS report of repalrs and cost as
requlred by Section 5617 of the Streets and H1ghways COde; and
wHEREAS, upon the day and hour fixed for hearing by Resolution
Number 7095 (CCS) , the City Council of the C1ty of Santa Monica heard
and passed upon the report of the Superlntendent of Streets together
w1th all Ob]ect10ns and protests as required by Sectlon 5618 of the
Streets and Hlghways COde;

NOW, THEREFORE, THE CUY COUNCIL OF THE CUY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION l. The report of the Superintendent of Streets
heretofore flIed and above-described be and the same 18 hereby
confirmed.
SECTION 2. All protests and obJections of every klnd and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denied.
SECTION 3. The cost of the repairs, as set forth 1n the
report of the Super1ntendent of Streets, shall be assessed against the
properties thereln descr1bed, WhlCh propertles front upon the sldewaIk
upon WhlCh the repalrs were made.
SECTION 4. If such assessment lS not pald wlthin the time
permltted by law, the same shall const1tute a speclal assessment
against and lien on the propertles thereln described, ln the amount
set forth ln the report of the Superlntendent of Streets, WhlCh llen
shall cont1nue untll tne assessment and all 1nterest thereon 1S pald
or untll lt 1S dlscharged of record.
SECTION 5. If the assessment is not pald wlthin the time
perm1tted by law, the Superintendent of Streets, 10 accordance wlth
Sectlon 5628 of the Streets and Hlghways Code, shall deliver a Notice
of Lien, prepared 1n the manner required by Sect10n 5626 of the
Streets and H1ghways Code, to the County Aud1tor who shall collect the
assessment together w1th all other taxes agalnst the property.

SECTION 6. The Clty Clerk shall certify to the adoption of
th1.s resolution and thenceforth and tnereafter the same shall be in
full force and effect.
