RESOLUTlON OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING TrlE REPORT OF THE SUPERINTENDENT
OF srREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-85-73)
WtIEREAS, the Street Superintendent of the Clty of Santa
MonIca, pursuant to Section 5600 to 5630 of the Streets and Hlghways
Code, commenced proceedlngs to cause the repaIr of damaged sldewalks,
drlveways and curbs ln the Clty of San ta Monlca at 921 Geor-3ina
Avenue, l27 Broadway, 1007 Ocean Avenue, 1843 9th Street, 1823
Mlchigan Avenue, 430 aroadway, 2802 l/2 Delaware Avenue, 647 Ashland
Avenue, 3340 Delaware Avenue, 823 Plne Street, 2921 Main Street, 332
17th Street, 333 Santa Monlca Boulevard, all wlthln the Clty of Santa
Monica; and
WHEREAS, SlXty days after Sald order was served, the work had
not been completed by the owners or persons in possession of the
affected propertles, and the Superlntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notlce
requlred by Section 5616 of the Streets and Hlghways Code; and
\'lrlEREAS, the Superlntendent of Streets dld file wlth the City
Councll of ~he Clty of Santa Monica h15 report of repalrs and cost as
requlred by Section 5617 of the Streets and H~ghways Code; and
WHEREAS, upon the day and hour flxed for hearlng by Resolutlon
Number 7,120. . (CCS) 1 the City Council of the Clty of Santa Monlca heard
and passed upon the report of ~he Superlntendent of Streets together
wlth all objectlons and protests as requlred by Section 5618 of the
Streets and Hlghways Code;

NOW, THE CI'rY COUNCIL OF OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION l. The report of the Superlntendent of Streets
heretofore flIed and above-descrlbed be and the same 15 hereby
conflrmed.
SECrrON 2. All protests and obJections of every kind and
nature to the report of the Superlntendent of Streets be and the same
are hereby overruled and denled.
SECTION 3. The cost of the repairs, as set forth ln the
report of the Superlntendent of Streets, shall be assessed agaInst the
propertles thereln descrlbed, WhlCh propertles front upon the sldewalk
upon WhlCh the repairs were made.
SECT ION 4. If such assessment lS not pald withIn the tlmE!
permltted by law, the same shall constitute a special assessment
against and llen on the propertles thereln described, ln the amount
set forth in the report of the Superlntendent of Streets, WhICh llen
shall contlnue untl.l the assessment and all 1nterest thereon 1S pa ld
or untll it 1S d1scharged of record.
SECrION' 5. It the assessment is not pald wlth1n the tlmE!
permltted by law, the Super l.n tend en t of Streets, ln accordance with
Section 5628 of the Streets and Hlghways Code, shall dellver a Notlce
of Llen, prepared in the manner requlred by Sectlon 5626 of the
Streets and Hlghways Code, to the County Aud1tor who shall collect the
assessment together WIth all other taxes against the property.

SECTION 6. The CIty Clerk shall certlfy to the adoptlon of
thlS resolutIon and thenceforth and tnereafter the saine snaIl be in
full force and effect.
