A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMI~G THE REPOR'r OF THE
SUPERINTENDENT OF STREErS REGARDING THE
RESURFACING OF OZONE PLACE NORTH BETWEEN
LINCOLN BOULEVARD AND HIGHLAND AVENUE
WHEREAS, the Street Super~ntendent of the CIty of Santa
MonIca, pursuant to Sect~on 5870 et seq. of the Streets and
Highways Code, commenced proceedIngs to cause the resurfacing of
Ozone Place North between LIncoln Boulevard and HIghland Avenue;
and
WHEREAS, the Super~ntendent of Streets served the
notIce required by SectIon 5876 of the Streets and HIghways Code
and the CIty Counc~l of the CIty of Santa MonIca held the hearing
required by SectIon 5878.1 of the Streets and HIghways Code; and
WHEREAS, s~xty (60) days after the not~ce was served,
the work had not been completed by the owners or persons in
posseSSIon of the affected propert~es, and the Superintendent of
Streets caused the work to be done; and
wHEREAS, the SuperIntendent of Streets gave the notIce
reqUIred by SectIon 5881 of the Streets and HIghways Code; and
WHEREAS, the SuperIntendent of Streets dId hle with the
City CounCIl of the City of Santa Monica his report of
resurfacing and cost as reqUIred by SectIon 5882 of the Streets
and HIghways Code; and

WHEREAS, upon the day and hour flxed for hearlng by
ResolutIon Number 7115 (CCS} , the CIty Council of the City of

Santa Monica heard and passed upon the report of the
SuperIntendent of Streets together with all obJectIons and
protests as requlred by Section 5883 of the Streets and Hlghways
Codei
NOw, 'rHEREF0RE, THE CITY COUNCIL OF THE CITY OF SAi'lTA
MONICA DOES RESOLVE AS FOLLOwS:
SECTIOi."l l. The report of the Superintendent of Streets
heretofore hI ed and above-descrIbed be and the same IS hereby
confIrmed.
SECTION 2. All protests and ObJections of every kInd and
nature to the report of the SuperIntendent of Streets be and the
same are hereby overruled and denled.
SECrrON 3. The cost of resurfacing, as set forth in the
report of the SuperIntendent of Streets, shall be assessed
agaInst the propertIes thereln descrIbed, WhICh propertIes are
adJacent to Ozone Alley North between LIncoln Boulevard and
Hlghland Avenue.
SEC-nON 4. If such assessment lS not pald WIthIn the
tIme permitted by law, tne same shall constItute a speCIal
assessment agalnst and lIen on the properties thereIn described,
in the amount set forth in the report of the Superintendent of
Streets, WhICh lIen shall contInue until the assessment and all
Interest thereon is paId or untIl it is discharged of record.

SECrION 5. If the assessment is not pald wlthln the time
perm1tted by law, the Superlntendent of Streets, in accordance
wltn Sectlon 5893 of the Streets and Hlghways Code, shall dellver
a Notlce of Llen, prepared In the manner required by Section 5891
of the Streets and Hlghways Code, to the County Auditor who shall
collect the assessment together wlth all other taxes agalnst the
property.
SECTION 6. The Clty Clerk shall certify to the adoption
of thlS resolution and thenceforth and thereafter the same shall
be 10 full force and effect.
