A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF
SANTA MONICA PERTAINING TO
PICTURES FOR COMMERCIAL
PURPOSES
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. Plctures For Commerclal Purooses.
A. The Department of General Services shall issue all
permIts for the use of any CIty property for any purposes.
Applicat10ns for such perm1ts shall be made upon forms provided
by the Department of General Servlces.
Such perm1ts shall
specnfy the locatIon to be used. the datels) and tIme[s) for
WhICh such permIt 1S desIred and shall set forth such specIal
conditions regard1ng the use of such permIts as the D1rector of
General Serv1ces shall, In his or her discretion. determine.
Such permIts shall also set forth the fee or charge which lS to
be pa1d to the C1ty at the tIme the permIt 1S Issued.
Each permIt Shall spec1fy that no reference shall be made by
dialouge or pIcture to the Santa MonIca Police Department. 1ts
offIcers or personnel, or to the CIty of Santa Monica, except as
persons fam1llar w1th the community mIght recognize the locale.

B.
Fees.
The schedule of fees to be charged for the
1ssuance of a perm1t for the filming of commercial motion
pIctures, commerc1al teleV1s10n fIlms, or commercial st1ll
photography on C1ty property, for each day or portIon thereof are
hereby establIshed as follows:
Fees for all stIll photography

Fees for commercIal mot10n pIcture

C. Fees far use of CIty personnel. For any location or area
the use of whIch OccaSIon specIal dIffIculty or expense to the
City. thereby reqUIrIng the use of City personnel 1n any capac1ty
1n connection WIth such commercIal fIlming or photography, and
for the use of CIty personnel for general assistance,
supervIsion. or other purposes for such fIlming or photography,
an addlt10na1 charge shall be made aga1nst and payable by the
permIttee at the rate of F1fteen Dollars ($151 per hour per
employee.
D Penalty fees. NotWIthstanding any other provision in
th1s resolution, no film1ng of commercIal mot10n pictures,
commercla1 telev1sIon films, or commerc1a1 st1l1 photography on
City property shall be InstItuted by any permIt holder In any
residential ne1ghborhood of the City after 10:00 o'clock p.m. In
addit1an to any other penaltIes provided by law, 1n the event

that a permlttee or other person v10lates the prov1sions of this
subsectlon, an addltlonal fee shall be charged as follows:

Insurance.
Each perm1t shall conta1n a statement that
the permlttee holds the Clty harmless from any and all liability
for personal lnJury and property damage ar1s1ng out of the use of
the permit and the use of Clty property and facl11tles. In
addit10n, as a condItIon of the Issuance of a perm1t, the
permlttee shall fIrst provIde pUblIC 1iabIltty insurance naming
the CIty of Santa MonIca, 1tS Clty Counc11, boards and
commlssIons, off1cers. agents. servants and employees as
cO-Insureds, in amounts of not less than a comblned sIngle-limit
P011CY With aggregate 11mIts in the amount of $1,000,000. Such
certificate of Insurance shall be furn1shed to the Director of
General Serv1ces and shall further conta1n a prov1s10n that
notlce ln writlng 1S to be prov1ded to the D1rector of General
Services wlthin thIrty (30) days prior to cancellatIon of such
poliCY

The DIrector of General Serv1ces, upon applicat10n for a
sha 11 reVIew the same. and may seek the advIce of such
CIty departments as may be affected by the requested
permIt.

Issuance of such a perm1t would const1tute a hazard to the
welfare of the commun1ty or Its c1tlzens or, pose a threat to

The City Clerk shall certify to the adoptIon of
th1s Reso1ut1on. and thenceforth and thereafter the same shall be
in full force and effect.
