RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-75)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Sectlon 5600 to 5630 of the Streets and Hlghways
Code, commenced proceedlngs to cause the repalr of damaged sidewalks,
drlveways and curbs in the Clty of Santa Monlca at 2343 32nd St., 2341
32nd St. , 2344 32nd St. , 2340 32nd St., 2418 32nd St. , 2432 32nd St. ,
2411 32nd St. , 2401 32nd St. , 2419 32nd St., 3129 Pearl St. , 2435 32nd
St., 2404 32nd St., 2508 32nd St., 2423 32nd St. , 2648 32nd St., and
2336 32nd St., all wlthln the Clty of Santa Mon1ca.
WHEREAS, sixty days after sald order was served, the work had
not been completed by the owners or persons 1n possesslon of the
affected properties, and the Super1ntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
requlred by Sect10n 5616 of the Streets and Highways Code~ and
WHEREAS, the Super1ntendent of Streets did flle with the City
Councll of the City of Santa Monlca his report of repairs and cost as
requlred by Sect10n 5617 of the Streets and Hlghways Code~ and
WHEREAS, upon the day and hour fixed for hearing by Resolution
Number 7142 (CCS), the Clty Counc11 of the City of Santa Monica heard
and passed upon the report of the Superintendent of Streets together
with all objections and protests as required by Sect10n 5618 of the
Streets and H1ghways Code;
NOW, THEREFOR~THE CITY COUNCIL OF THE ~Y OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.

SECTION 2. All protests and ObJections of every klnd and
nature to the report of the Superlntendent of Streets be and the same
are hereby overruled and den1ed.
SECTION 3. 1'he cost of the repaHs, as set forth in the
report of the Superintendent of Streets, shall be assessed against the
properties thereln descrIbed, which propert1es front upon the sidewalk
upon Wh1Ch the repalrs were made.
SEe-rION 4. If such assessment is not paid wi thln the time
permitted by law, the same shall const1tute a speclal assessment
agalnst and llen on the propert1es therein described, 1n the amount
set forth in the report of the Superlntendent of Streets, Wh1Ch lien
shall COntInue unt1l the assessment and all 1nterest thereon is paid
or until it is discharged of record.
SECTION 5. If the assessment is not paid Wl thln the tIme
permitted by law, the Superintendent of Streets, in accordance with
Sectlon 5628 of the Streets and Hlghways Code, shall deliver a Not1ce
of L1en, prepared in the manner requlred by Section 5626 of the
Streets and H1ghways Code, to the County Audltor who shall collect the
assessment together wlth all other taxes agalnst the property.

SECTION 6. The CIty Clerk shall certify to the adoptIon of
this resolution and thenceforth and thereafter the same shall be in
full force and effect.
