A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERI~TENOENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-52)
WHEREAS, the Street Superintendent of the Clty of Santa
Monica, pursuant to Sectlon 5600 to 5630 of the Streets and
Highways Code, commenced proceedlngs to cause the repair of
damaged sldewalks, driveways and curbs in the City of Santa Monica
at 731 San Vicente, 2023 Virginia, 2012 Vlrginla, 2207 Virginia,
2213 Vlrginla, 2219 Virginia, 2223 Virginia, 2231 Virginia, 815
San Vlcente, 2260 Washlngton, 3010 17th St., 3213 17th St., 3004
17th St., 3111 17th St.. 3014 17th St., 3197 17th St., 3114 17th
St., 3003 17th St. and 3001 17th St.; and
WHEREAS, Slxty days after said order was served, the
work ~ad not been comp1eted by tne owners or persons in possesslon
of the affected propertles, and the Superintendent of Streets
caused the work to be done; and
WHEREAS. the Superintendent of Streets gave the notlce
requlred by Sectlon 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superintendent of Streets dld file with the
City Councll of the Clty of Santa Monlca hlS report of repalrs and
cost as required by Section 5617 of the Streets and Highways Code;
and

WHEREAS. upon the day and hour f1xed for hearing by
Resolution Number 6754 (CCS). the C1ty Counc11 of the City of
Santa Mon1ca heard and passed upon the report of the
Super1ntendent of Streets together with all object1ons and
protests as required by Sect10n 5618 of the Streets and Highways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore filed and above-described be and the same is
hereby confirmed.
SECTION 2. That all protests and objections of every
k1nd and nature to the report of the Super1ntendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repa1rs, as set forth
in the report of the Super1ntendent of Streets, shall be assessed
aga1nst the propert1es therein described, which properties front
upon the sidewalk upon Wh1Ch the repairs were made.
SECTION 4. That if such assessment is not paid within
the tlme perm1tted by law, the same shall constitute a special
assessment aga1nst and lien on the propert1es there1n described.
1n the amount set forth 1n the report of the Superlntendent of
Streets, which 11en shall cont1nue until the assessment and all
interest thereon is paid or untll it is discharged of record.

SECTION 5. That if the asssessment is not paid within
the tlme permltted by law, the Superlntendent of Streets, in
accordance wlth Section 5628 of the Streets and Hlghways Code.
shall deliver a Notlce of Llen, prepared in the manner required by
Section 5626 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together with all other
taxes agalnst the property.
SECTION 6.
That the Clty Clerk shall certlfy to the
adoptlon of this resolution and thenceforth and thereafter the
same shall be i n full force and effect.

STREET SUPERINTENDENT'S REPORT
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS,
AND/OR REMOVAL OF OBSTRUCTIONS, PERFORMED
UNDER PROVISIONS OF DIVISION 7, CHAPTER 22,
SECTIONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-83-52)
Pursuant to the provislons of Dlvlslon 7, Chapter 22,
Sect10ns 5600 to 5630, of the Streets and H1ghways Code of the
State of California. the following work was caused to be done by
the Street Superintendent:
The removal and replacement of 939 square feet
of PC concrete an sldewa1ks at $4 per square
foot;
The removal and replacement of 101 square feet
of PC concrete on drlveways at $5 per square
foot;
The removal and replacement of 12 lineal feet
of PC concrete curb at $10 per llnea1 foot;
and
The total cost of the above work was $4,381.00.
The total proposed assessment for the above sldewalk and
curb damage is $2,190.50 or 50 percent of the total cost. The
other 50 percent of the cost 1S belng pald by the C1ty as the
above repairs were caused by tree root damage.
