A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA CERTIFYING
THE FINAL ENVIRONMENTAL IMPACT REPORT
ON THE DEVELOPMENT AGREEMENT BETWEEN
MARTIN CADILLAC COMPANY, INC., AND
THE CITY OF SANTA MONICA
WHEREAS, app11cat10n for a Development Agreement between the
Mart1n Cad11lac Company, Inc, and the C1ty of Santa Monica for
property located at 3300 Olymp1c Boulevard was made 1n May, 1983;
and
WHEREAS, an In1t1al Study was prepared on the proposed
prOject 1n June 1983; and
WHEREAS, a Not1ce of Preparat10n of an Env1ronmental Impact
Report was issued 1n July 1983; and
WHEREAS, Notice of Complet10n of a Draft Env1ronmental
Impact Report was publ1shed 1n August 1983, 1n comp11ance w1th
the Cal1forn1a Env1ronmental Qual1ty Act; and
WHEREAS, a publ1C reV1ew per10d exp1red 1n September 1983;
and
WHEREAS, 1n September 1983, the complet10n of the F1nal
EnV1ronmenta1 Impact Report on the proposed proJect, cons1stlng
of the Draft Env1ronmental Impact Report, comments on the
document, and responses to comments was certlfled; and

WHEREAS, on October 25, 1983, the CIty Councll conducted a
publicly noticed hearIng on the FInal EnvIronmental Impact
Report.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The CIty CouncIl of the CIty of Santa MonIca
does hereby certIfy that the FInal EnvIronmental Impact Report on
the proposed Development Agreement between MartIn Cadillac, Inc.,
and the CIty of Santa MonIca has been completed In full
complIance wIth the CalIfornIa EnVIronmental QualIty Act, the
State EnVIronmental Impact Report GuidelInes, and the CIty of
Santa MonIca CEQA GUIdelInes. In conJunctIon WIth thIS
certIfIcatIon, the CIty CounCIl fInds as follows:
a. The Final EnVIronmental Impact Report has IndIcated that
the fOllOWIng SIgnIfIcant effects on the enVIronment, as defIned
In TItle 14 CalIfornIa AdmInIstratIve Code, SectIon 15040, may
result from the approval of the proposed development in the
absence of mItIgatIon measures:
o Land Use. ThIS project raIses potentIally SIgnIfIcant
Issues relatIve to land use due to the dIvergence between the
CIty'S eXIstIng and proposed land use polICIes. Where the
proJect complIes WIth one set of polIcies, It often does not
comply WIth the other and VICe versa. While the consequences
of the proJect's comparIson WIth these eXIstIng and emergIng

po11cles were not found to be slgnLficantly adverse as meant
by CEQA or even adverse in several instances, thlS background
of transit10n 1n the C1ty'S land use regulatory framework
creates a decisionmaking d1lemma of potent1ally signif1cant
proportions.
o C1rculat1on. The system of slte access proposed to serve the
proposed off1ce complex as well as the automob11e dea1ershlp
would be expected to generate unacceptably hazardous
veh1cular operatLng cond1tions on the publ1C streets
adJo1nlng the project slte.
o Parklng. Each of the proJect's major use components have the
potentlal to produce more park1ng demand than can be
accommodated wlthln the on-slte parklng fac1lities servlng
eLther the off1ce complex or the automobl1e dealership.
Because the nearest area of on-street parklng capaclty lS
adJo1n1ng and w1thln a resldent1al area located to the south
of the project slte, off-s1te parklng demand assoclated wlth
the proposed project could have potentlally sign1flcant
1ntruslve effects there, dependlng upon local perceptlon.
o Hous1ng. Analysis Lodlcates that the off1ce component of the
project wll1 generate a housing 1mpact demand for between 31
and 40 affordable houslng unlts; a slgn1flcant1y adverse
1mpact 1n the absence of mltlgatlon.
o f~~~~l_l~E~~l. The project lS expected to produce an
annually recurrlng flscal surplus of over $400,000. In Vlew
of the municlpal programs havlng direct envlronmental beneflt

that could be contlnued, expanded, or lnltlated, this impact
lS consldered slgnlflcant.
b. In accordance wlth Resources Code Sectlon 21081 and Tlt1e
14 Callfornla Admlnistratlve Code Sectlon 15088, the City Council
flnds that whlle potentlal slgniflcant effects have been
ldentlfled, the followlng changes or alteratlons have been
requlred ln, or lncorporated lnto the project Wh1Ch m1t1gate or
avold the slgnlflcant envlronmenta1 effects as 1dent1f1ed by C1ty
analysls and 1n the Flna1 Envlronmental Impact Report:
(1) Land Use. The project des1gn has been revlsed to reduce lot
coverage from 89% to 58%, and 1n add1tlon, adjusted gross floor
area of the offlce component has been reduced from 267,000 sq.
ft. to 226,127 sq.ft., reduclng the overall Floor Area RatlO.
(2) Clrcu1atlon. Due to a net reduction In adjusted gross floor
area ln the proposed offlce complex, a reductlon in project
trafflc generatlon should be expected due to the proposed
reV1Slons. Thus, the revlsed proJect's lmpacts at each of the
lntersectlons evaluated In the Draft EIR should be lncrementally
reduced. More slgnlflcantly, the current project concept
lmp1ements each of the mitlgatlon measures recommended relative
to vehlcular slte access 1n the Draft EIR (pages 92-93)
correctlng what were consldered potent1ally slgnlf1cant adverse
access deflclencles In the orlglnal concept. In addltlon, the
current concept's revlsed garage entrance deslgn wlthin the
proJect's Centlnela Avenue setback now accommodates a posslble
dedicatlon of 12 to 13 feet along the slte's eastern property

full lane.
(3) Park1ng. The proposed Development Agreement has been reV1sed
to 1nclude a reqU1rement that the prOject owner provide $50,000
to the City to fund start-up costs of a preferential parking
dlstr1ct in the reSidential area south of the proJect, and to
prov1de $5,000 per year for operat1on costs of such district. In
add1t1on, the project owner 1S requIred to prepare and submIt for
CIty approval a Transportation Systems Hanagement Plan to
mlt1gate park1ng demand at the proJect.
(4) HOUSIng. The proposed Development Agreement 1ncludes a
proviSion that the project owner w1ll guarantee a revenue stream
to the C1ty equal or greater than est1mated c1ty costs, 1ncludlng
hous1ng and arts and SOCIal serVIces 1mpacts.
(5) F1scal Impact. The slgnlf1cant pos1t1ve f1scal 1m pact of the
prOject 1S VIewed as a benefICial effect.
SECTION 2.
The C1ty Clerk shall certify to the adoption of
thIS Resolut1on, and thenceforth and thereafter the same shall be
1n full force and effect.
