RESOLUTION NO. 6776

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-53)
WHEREAS, the Street Superintendent of the City of Santa
Monlca, pursuant to Section 5600 to 5630 of the Streets and
Highways Code. commenced proceedings to cause the repalr of
damaged sidewalks, driveways and curbs in the City of Santa Monlca
at 2920 17th St., 3201 17th St., 2910 17th St., 3015 17th St.,
3021 17th St., 3217 17th St.. 1701 Pler Ave.. 3122 17th St.. 3118
17th St.. 1666 Bryn Mawr, 3202 17th St., 3216 17th St., 3106 17th
St., 3210 17th St., 3009 17th St., 1649 Wellesley, 1114 Bay St.,
1118 Bay St., 1124 Bay St., 1128 Bay St., 1132 Bay St., 2039 11th
St., 1101 Bay St.; and
WHEREAS, sixty days after sald order was served, the
work had not been completed by the owners or persons ln possession
of the affected properties, and the Superlntendent of Streets
caused the work to be done; and
WHEREAS. the Superlntendent of Streets gave the notice
requlred by Sectlon 5616 of the Streets and Highways Code; and
WHEREAS, the Superlntendent of Streets did file wlth the
City Council of the City of Santa Monlca hlS report of repairs and
cost as required by Section 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour flxed for hearing by
Resolut1on Number 6762 (CCS), the City Councl1 of the City of
Santa Monlca heard and passed upon the report of the
Super1ntendent of Streets together with all obJections and
protests as requlred by Sectlon 5618 of the Streets and Highways
Co de ;
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Super1ntendent of
Streets heretofore flled and above-descrlbed be and the same is
hereby conflrmed.
SECTION 2. That all protests and objectlons of every
klnd and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repairs, as set forth
1n the report of the Super1ntendent of Streets, shall be assessed
agalnst the properties thereln described, which properties front
upon the sldewa1k upon which the repalrs were made.
SECTION 4. That if such assessment 1S not paid within
the tlme permitted by law, the same shall constitute a special
assessment against and lien on the propertles therein described,
in the amount set forth in the report of the Superintendent of
Streets, which lien shall continue until the assessment and all
interest thereon 1S paid or until it 1S discharged of record.

SECTION 5. That 1f the asssessment 1S not paid with1n
the tlme permitted by law, the Superlntendent of Streets, 1n
accordance wlth Section 5628 of the Streets and Hlghways Code,
shall deliver a Notice of Lien, prepared in the manner required by
Section 5626 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together w1th all other
taxes agalnst the property.
SECT! ON 6.
That the City Clerk shall certify to the
adoptlon of thlS resolution and thenceforth and thereafter the
same shall be in full force and effect.
