RESOLUTION NO.6793(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-54)
WHEREAS, the Street Superlntendent of the Clty of Santa
Monica, pursuant to Sectlon 5600 to 5630 of the Streets and
Highways Code, commenced proceedlngs to cause the repair of
damaged sldewalks, drlveways and curbs in the Clty of Santa Monlca
at 1105 Bay St., 954 20th St., 1044 20th St., 1138 20th St.,
1102-1104 20th St., 1120 20th St., 2002-2004 Idaho, 1018 20th St.,
910 20th St.. 914 20th St., 942 20th St., 1008 20th St., 920 20th
St., 810 20th St., 824-826 20th St., 830 20th St., 840 20th St.,
848 20th St. and 848 26th St.; and
WHEREAS, sixty days after sald order was served, the
work had not been completed by the owners or persons in possesslon
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superlntendent of Streets gave the notlce
required by Sectlon 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets did file wlth the
Clty Councl1 of the Clty of Santa Monlca his report of repairs and
cost as required by Section 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour f1xed for hearing by
Resolution Number 6771 (CCS), the C1ty Council of the C1ty of
Santa Mon1ca heard and passed upon the report of the
Superintendent of Streets together with all obJections and
protests as requ1red by Sect10n 5618 of the Streets and H1ghways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITV OF SANTA
MONICA DOES HEREBY RESOLVE AS FOllOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore f1led and above-described be and the same is
hereby conf1rmed.
SECTION 2. That all protests and object1ons of every
k1nd and nature to the report of the Super1ntendent of Streets be
and the same are hereby overruled and den1ed.
SECTION 3. That the cost of the repa1rs, as set forth
1n the report of the Super1ntendent of Streets, shall be assessed
aga1nst the properties there1n descr1bed, Wh1Ch properties front
upon the sldewalk upon Wh1Ch the repairs were made.
SECTION 4. That if such assessment is not pa1d within
the t1me perm1tted by law, the same shall constitute a special
assessment aga1nst and lien on the properties therein descr1bed,
1n the amount set forth 1n the report of the Super1ntendent of
Streets, Wh1Ch llen shall continue until the assessment and all
1nterest thereon 15 paid or unt1l 1t 1S dlscharged of record.

SECTION 5. That if the asssessment 1S not paid within
the t1me perm1tted by law, the Super1ntendent of Streets, in
accordance with Sectlon 5628 of the Streets and Highways Code,
shall deliver a Not1ce of Lien, prepared 1n the manner requ1red by
Section 5626 of the Streets and Highways COde, to the County
Auditor who shall collect the assessment together with all other
taxes agalnst the property.
SECTION 6.
That the City Clerk shall certify to the
adopt1on of th1S resolutlon and thenceforth and thereafter the
same shall be 1n full force and effect.
