A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A PUBLIC HEARING AND
INSTRUCTING THE SUPERINTENDENT OF STREETS TO
GIVE NOTICE TO PROPERTY OWNERS TO CONSTRUCT
GUTTERS AND TO RESURFACE VARIOUS CITY STREETS
IN CONJUNCTION WITH THE 1983-84 STREET
RESURFACING PROGRAM
WHEREAS, there is a need to construct concrete gutters
and to resurface along certaln Clty streets, all wlthln the Clty
of Santa Monlca; and
WHEREAS, in accordance with Sectlon 5870 !l seq. of the
Streets and Hlghways Code procedures exist to notlfy property
owners of thelr duty to construct or cause to be constructed the
concrete gutters and to resurface or cause to be resurfaced
streets and to dlrect the Superintendent of Streets to construct
the concrete gutters and to resurface the streets if not
constructed or caused to be constructed by the property owners;
and
WHEREAS, the Clty Council of the Clty of Santa Monica
on its own motion may order the construction of the concrete
gutters and the resurfaclng of streets.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Sectlon 5875 of the Streets and
Hlghways Code, the Clty Councll of the Clty of Santa Monica
orders the construction of concrete gutters and the resurfaclng
of streets on Colorado between 9th and 14th Streets, Michigan
between Cloverfleld and the easterly deadend, Marlne between

Llncoln and 150 feet west of Lincoln. Pler between Llncoln and
150 feet west of Llncoln. and Pier between Second and Nellson
Way.
SECTION 2. Pursuant to Section 5876 of the Streets and
Hlghways Code, the Superlntendent of Streets shall notify, ln the
manner requlred by law, the owners of property on Colorado
between 9th and 14th Streets, Michigan between Cloverfield and
the easterly deadend. Marlne between Llncoln and 150 feet west of
Llncoln. Pler between Lincoln and 150 feet west of Llncoln, and
Pler between Second and Nellson Way to construct or cause to be
constructed concrete gutters and to resurface or cause to be
resurfaced streets. The notlce shall contaln the lnformation
required by Sectlon 5879 of the Streets and Hlghways Code and
shall also speclfy the day, hour and place. as set forth ln
Sectlon 3 of thlS Resolutlon, where the City Councll of the City
of Santa Monlca wlll hear and pass upon Objections or protests,
lf any, WhlCh may be ralsed by property owner or other interested
pe rsons.
SECTION 3. That pursuant to Section 5878.1 of the
Streets and Hl ghways Code, the Clty Counci 1 of the City of Santa
Monica does hereby order and declare that on the 14th day of
February, 1984, at 7:30 P.M. ln the Councll Chambers of Clty
Hall, it wlll hear and pass upon objectlons or protests, if any,
WhlCh may be ralsed by any property owner or other lnterested
person.

SECTION 4.
The City Clerk shall certify to the
adoptlon of thlS Resolution and thenceforth and thereafter the
same shall be in full force and effect.
