A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA PERTAINING TO
PICTURES FOR COMMERCIAL PURPOSES
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. P1ctures For CommercIal Purroses.
A. The Department of General ServIces shall Issue all
permIts for the use of any Clty property for any purposes.
ApplIcatIons for such perm1ts shall be made upon forms provIded
by the Department of Gereral Services.
Such permits shall
specify the locatIon to be used, the date(s) and tIme(s) for
WhICh such permIt IS desIred and shall set forth such specIal
conditIons regard1ng the use of such permIts as the DIrector of
General SerVIces shall, In his or her dIscretIon, determlne.
Such permIts shall also set forth the fee or charge which IS to
be paId to the CIty at the tIme the permIt IS Issued.
Each permIt shall speclfy that no reference shall be
made by dIalouge or pIcture to the Santa Mon1ca Police
Department, Its offIcers or personnel, or to the CIty of Santa

Monlca, except as persons famlllar wIth the communlty mIght
recognize the locale.
B.
Fees.
The schedule of fees to be charged for the
Issuance of a permIt for the fIlmlng of commercIal motlon
plctures, commerc1al televlslon fllms, or commercIal still
photography on CIty property, for each day or portlon thereof are
hereby establ1shed as follows:

C.
Fees for use of Clty personnel.
For any locatIon or
area the use of WhlCh occaSIon speCIal dIfflculty or expense to
the CIty, thereby requIrlng the use of Clty personnel In any
capacIty In connection wlth such commerclal fllmlng or
photography, and for the use of Clty personnel for general
asslstance, superV1Slor, or other purposes for such fllmlng or
photography, an addltlonal charge shall be made agalnst and
payable by the permlttee at the rate of Flfteen Dollars ($15) per
hour per employee.
D. Peralty fees. Notwlthstandlng any other proVlslon In
thls resolutIon, reo f11mlng of commercla1 motlon pictures,
commerclal televlslon fllms, or commerclal stlll photography on
Clty property shall be Instltuted by any permit holder ln any
resldentlal neIghborhood of the Clty after 10:00 o'clock p.m.
In addltlon to any other pe~altles provlded by law, ln the event

E.
Insurance.
Each permIt shall contain a statement that
the permIttee holds the Clty harmless from any and all liabilIty
for personal InjUry a~d property damage arIsIng out of the use of
the permIt and the use of City property and facIlItIes. In
addItIOro, as a oordltlon of the Issuance of a permIt, the
permIttee shall fIrst provIde publIC lIabilIty insurance namIng
the CIty of Santa Monica, Its CIty CounCIl, boards and
commiSSIons, offIcers, agents, servants and employees as co-
I~sureds, In amounts of root less than a combIned SIngle-lImIt
policy wIth aggregate lImIts In the amount of $1,000,000. Such
certIfIcate of Insurance shall be furnIshed to the Director of
General SerVIces and shall further contaIn a provislon that
notIce in wrItIng IS to be prOVIded to the DIrector of General
SerVlces w1thln thIrty (30) days prlor to cancellatIon of such
pellCY.
F. The DIrector of General SerVIces, upon applicatIon for
a permIt, shall review the same, and may seek the adVIce of such
other CIty departments as may be affected by the requested

fllmlng or photography activltles prlor to lssuance of such a
permlt. If the Dlrector of General Servlces fIr,ds that the
Issuance of such a permlt would constitute a hazard to the
welfare of the communlty or its cItizens or, pose a threat to
publ1C safety, or endanger Ilves or property, he or she may
refuse to lssue the perm1t applIed for.
G. Students and non-profIt orgar.lzations. A permIt, as
provIded for hereIn, must be obtaIned by students or non-profl t
organ1zat1ons pr10r to engaglng In the act1v1t1es descrIbed
here1r., but no fee shall be requ1red of the same therefore.
Students shall supply a wr1tten cert1flcate from the school of
theIr attendance WhICh shall state that they are bona fIde and
currer.tly enrolled students of such school. Nor-profIt
organIzatIons shall supply a certIfIcate statIng that they are
exempt and classlfled as ron-profit under federal and state
tax ing statutes.
H. EducatIonal f1lms. For the purposes of this Resolution
arc educatIonal fIlm shall be one WhICh prov1des Instruction,
espec1ally for students, ultImately lImIted to classroom use, and
a fIlm for WhICh r,o admIssIon charges WIll be made. However, any
educat10nal f1lm as def1ped above, WhICh IS not made for the
purpose of sale, lease or rental, and not so sold, leased or
rerted, shall be exempt from the $100 educatIonal fee. The
DIrector of General ServIces shall have dIscretIon hereunder to
