A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING GUTTER
CONSTRUCTION AND STREET RESURFACING ON SECOND
STREET BETWEEN BROADWAY AND WILSHIRE AND
SIXTEENTH STREET BETWEEN COLORADO AND 50 FEET
SOUTH OF THE SOUTHERN PACIFIC RAILROAD, ALL
WITHIN THE CITY OF SANTA MONICA
WHEREAS, the C1ty Council of the Clty of Santa Mon1ca,
pursuant to Sectlon 5870 et seq. of the Streets and Hlghways
Code, commenced proceedlngs to cause the constructlon of gutters
and the resurfac1ng of streets on Second Street between Broadway
and Wilshire and Slxteenth Street between Colorado and 50 feet
south of the Southern Paclflc Ra11road; and
WHEREAS, the Super1ntendent of Streets served the
not1ce requ1red by Sectlon 5876 of the Streets and Hlghways Code
and the Clty Councll of the Clty of Santa Monlca held the hearlng
requlred by Sect10n 5878.1 of the Streets and Hlghways Code; and
WHEREAS, Slxty (60) days after the not1ce was served,
the work had not been completed by the owners or persons 1n
possession of the affected propertles, and the Superlntendent of
Streets caused the work to be done; and
WHEREAS, the Superlntendent of Streets gave the notlce
requlred by Sect10n 5881 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets d1d f11e wlth
the C1ty Counc1l of the C1ty of Santa Monlca hlS report of
constructlon and cost as requ1red by Sectlon 5882 of the Streets
and Hlghways Code; and

WHEREAS, upon the day and hour fixed for hear1ng by
Resolutlon Number 6803 (CCS) the C1ty Counc1l of the City of
Santa Monlca heard and passed upon the report of the
Super1ntendent of Streets together wlth all objections and
protests as requlred by Sect10n 5883 of the Streets and H1ghways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superlntendent of
Streets heretofore f1led and above-described be and the same 1S
hereby conf1 rmed.
SECTION 2. That all protests and obJect10ns of every
kind and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and den1ed.
SECTION 3. That the cost of the reconstruction, as
set forth 1n the report of the Super1ntendent of Streets, shall
be assessed agalnst the propert1es there1n descr1bed, Wh1Ch
properties front upon the gutters so constructed and streets
resurfaced.
SECTION 4. That 1f such assessment 1S not pa1d w1thln
the tlme perm1tted by law, the same shall const1tute a speclal
assessment aga1nst and llen on the propert1es there1n descr1bed,
in the amount set forth 1n the report of the Superintendent of
Streets, WhlCh 11en shall cont1nue unt1l the assessment and all
1nterest thereon 1S pa1d or unt1l lt 1S d1scharged of record.
SECTION 5. That 1f the assessment 1S not pa1d w1th1n
the t1me perm1tted by law, the Superintendent of Streets, 1n

accordance w1th Sectlon 5893 of the Streets and H1ghways code,
shall del1ver a Not1ce of L1en. prepared 1n the manner requ1red
by Section 5891 of the Streets and H1ghways code. to the County
Aud1tor who shall collect the assessment together w1th all other
taxes aga1nst the property.
SECTION 6.
That the C1ty Clerk shall certify to the
adopt1on of th1S resolutlon and thenceforth and thereafter the
same sha 11 be 1 n full force and effect.
