RESOLUTION NO. 6821(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-84-55)
WHEREAS, the Street Super1ntendent of the City of Santa
Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and
Hlghways Code, commenced proceedlngs to cause the repalr of
damaged sldewalks, drlveways and curbs 1n the Clty of Santa Monlca
at 1125 Bay St. , 1131 Bay St. , 1137 Bay St. , 1201 Bay St. , 1209
Bay St. , 849 Ocean Ave. , 835 & 843 Bay St., 842 Bay St. , 852 Bay
St. , 820 Bay St. , 824 Bay St. , 821 Bay St., 601-613 Wllshire, 833
Bay St. , 1008 17th St. , 633 Ocean Ave. , 617 Ocean Ave., 1113 Bay
St. , 525 W11 shlre and 1530 W11shlre; and
WHEREAS, Slxty days after sald order was served, the
work had not been completed by the owners or persons 1n possesslon
of the affected propertles, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Super1ntendent of Streets gave the not1ce
requl red by Sect i on 5616 of the Streets and H1 ghways Code; and
WHEREAS, the Superlntendent of Streets dld flle wlth the
Clty Counc1l of the Clty of Santa Monlca hlS report of repal rs and
cost as requlred by Sect10n 5617 of the Streets and Hlghways Code;

WHEREAS, upon the day and hour fixed for hearlng by
Resolutlon Number 6800 (CCS), the Clty Council of the Clty of
Santa Monlca heard and passed upon the report of the
Superlntendent of Streets together wlth all obJectlons and
protests as requ1red by Sectlon 5618 of the Streets and Highways
Code,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Supen ntendent of
Streets heretofore flIed and above-descrlbed be and the same lS
hereby conflrmed.
SECTION 2. That al I protests and obJectlons of every
klnd and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repalrs, as set forth
In the report of the Supenntendent of Streets, shall be assessed
agalnst the propertles thereln descrlbed, WhlCh properties front
upon the sldewalk upon WhlCh the repa1rs were made.
SECTION 4. That lf such assessment 1S not paid W1thln
the tlme permltted by law, the same shall const1tute a special
assessment agalnst and 11en on the propertles thereln descr1bed,
In the amount set forth 1n the report of the Superlntendent of
Streets, Wh1Ch 11en shall contlnue untll the assessment and all
1nterest thereon 1S pald or unt11 It 1S dlscharged of record.

SECTION 5. That lf the asssessment 1S not pald wlth1n
the tlme perm1tted by law, the Superlntendent of Streets, 1n
accordance wlth Sectlon 5628 of the Streets and Hlghways Code,
snall del1ver a Notlce of Llen, prepared 1n the manner requ1red by
Sectlon 5626 of the Streets and H1ghways Code, to the County
Auditor who shall collect the assessment together with all other
taxes agalnst the property.
SECTION 6.
That the Clty Clerk shall cert1fy to the
adopt1on of th1S resolutlon and thenceforth and thereafter the
same shall be 1n full force and effect.
