CA;RMM:rmelectc City Counc11 Meet~ng 2-28-84 Santa Mon~ca, Cal~forn1a RESOLUTION NUMBER 6832{CCS} (C~ty Counc~l Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, JUNE 5, 1984 WHEREAS the C1ty Council deslres to subm1t, pursuant to Government Code Sect10n 34459, a proposed amendment to the C1ty Charter; and WHEREAS, Elections Code Sect10n 17050 author~zes the City Counc11 to provide that all ballots cast at the Special Mun~cipal Elect~on be counted at a central counting place; and WHEREAS, Elections Code Sect~on 5011 authorizes the City Council to dlrect the c~ty clerk to transmlt a measure appear~ng on the ballot to the city attorney to prepare an impart~al analys1s, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. A special mun~c~pal election shall be held in the City of Santa Monica on June 5, 1984, wh~ch ~s the elect~on required to place a measure before the voters subm1tted by the City Council. 1 . . SECTION 2. The ballots to be used at the Spec1al Mun~c~pal Elect10n shall be both as to form and matter contained therein such as may be requ1red by law. SECTION 3. The City Clerk 1S author1zed, 1nstructed, and d~rected to procure and furnish any and all offic1al ballots, notices, pr1nted matter and all suppl1es, equipment, and parapherna11a that may be necessary in order to properly and lawfully conduct the Special Municipal Elect1on. SECTION 4. The polls for the Special Mun1c1pal Election shall open at 7:00 a.m. of the day of the elect10n and shall remain open continuously unt1l 8:00 p.m. of the same day when the polls shall be closed except as prov1ded in Elect10ns Code Section 14301. SECTION 5. The not1ce of the time and place of hold1ng of the Spec1al Municipal Election 1S hereby given and the C1ty Clerk 1S authorized, 1nstructed and d1rected to give such further or additional not1ce of the elect10n in the t1me, form, and manner requ~red by law. SECTION 6. Pursuant to Elect10ns Code Sect10n 17050, ballots cast by voters at the Special Munic1pal Election shall be counted at a central place. Santa Mon1ca City Hall is designated as the central place to count ballots. Not1ce of the central count~ng place ~s hereby g~ven, and the City Clerk is authorized, ~nstructed and d~rected to g1ve such further or additional not~ce of the central counting place 1n the time, form, and manner required by law. 2 . . SECTION 7. At the Special Mun~cipal Election, the following proposit10n shall be subm1tted to the qualified electors of the C1ty of Santa Monica: PROPOSITION " ". Shall Sect10n 602 of the City Charter be amended to increase the monthly reimbursement for councilmembers YES from $50 per month for counc11members and $150 per month for the Mayor to $300 per month for the Mayor and counc11members and to prov1de that the C~ty Council may 1ncrease the $300 by NO ord1nance not to exceed the amounts pa1d councilmembers under state law in general law c1t1es of the same populat10n as the C1ty of Santa Monica? The City Clerk shall cause the text of the propos~tion, wh~ch is conta1ned in Exhibit 1 attached hereto and 1ncorporated by reference, to be mailed to all qua11fied voters w1th the sample ballot. In add1t10n to other not1ces and pub11cations requ1red by law, the City Clerk, not less than 40 days and not more than 60 days before the Spec1al Mun1clpal Election, shall cause the text of the proposit10n to be publ1shed once 1n the off1cial newspaper and in each edition thereof during the day of pub11cation. SECTION 8. Pursuant to Elections Code Section 5011, the C1ty Clerk 1S directed to transmit a copy of the each measure to be submitted to the voters to the City Attorney and the City 3 . . Attorney 1S dlrected to prepare an impartial analysis of each measure ~n accordance w1th the prov1slons of Elect10ns Code Section SOll. SECTION 9. In all part~culars not rec1ted in this Resolutlon, the Speclal Municipal Election shall be held and conducted as provided by law for holding municipal electlons in the city of Santa Monlca. SECTION 10. The C1ty Clerk 1S directed to send a copy of this Resolution to the Board of Superv~sors of the County of Los Angeles and to the Registrar of Voters. SECTION 11 . In the event the Special Municlpal Election lS consolidated with the Statewlde General Elect~on on the same date, the provisions of this Resolut~on applicable only 1n the event the elect~on ~s conducted by the C1ty shall be of no force or effect. SECTION 12. The C1ty Clerk shall cert~fy to the adoption of th~s Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: ~\-.~ Robert M. PROPOSAL BY CITY COUNCIL OF THE CITY OF SANTA MONICA TO BE SUBMITTED TO VOTERS OF PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF SANTA MONICA, CALIFORNIA Sect~an 602 of Article VI of the City Charter of the C1ty of Santa Monica shall be amended to read as follows: Section 602. C~~nsation. The members of the City Council shall receive no compensation for their services as such, but shall receive reimbursement for necessary travel and other expenses when on official duty out of the City on order of the City Counc~l and, in addition: (a) Until the municipal election at wh~ch members of the City Council are elected follow~ng the date of adoption of this Section, the Mayor shall receive the sum of $150.00 per month, which amount shall be deemed reimbursement of out-Of-pocket expend1tures and costs imposed upon him or her as serv~ng as Mayor, and all other members of the City Council shall receive the sum of $50.00 per month, which amount shall be deemed to be re1mbursement for out-of-pocket expenditures and costs imposed upon them in serving as members of the City Council. (b) After the munic~pal election at which members of the City Council are elected follow1ng the date of adoption of this Section, all members of the City Council shall receive the sum of $300.00 per month. which amount shall be deemed reimbursement for out-of-pocket expenditures and costs imposed upon them in serving as members of the City Council. By ordinance duly adopted by the City Council. the amount of the monthly reimbursement may be increased to an amount equal to the base salary that could be adopted by ordinance of a general law city of the same population as the City of Santa 1 RMM:elect8 . .' In addition, by ord1nance duly adopted by the City Council, the amount of the monthly reimbursement may be increased by an amount equal to five percent for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance is adopted. 2 . .
