R-6831 ~ e CA:RMM:rmelectb City Counc1l Meeting 2-28-84 Santa Monica, Ca11fornia RESOLUTION NUMBER 6831(CCS) (C1ty Counc11 Ser~es) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, JUNE 5, 1984 WHEREAS, the C~ty Counc11 desires to submit, pursuant to Government Code Section 34459, a proposed amendment to the City Charter; and WHEREAS, Elect10ns Code Section 17050 authorizes the City Counc1l to provide that all ballots cast at the Spec1a1 Municipal Elect10n be counted at a central countlng place; and WHEREAS, Elect~ons Code Section 5011 authorizes the Clty Councll to dlrect the Clty clerk to transm1t a measure appearing on the ballot to the C1ty attorney to prepare an ~mpartial analYS1S, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. A speclal munlcipal electlon shall be held 1n the C1ty of Santa Monica on June 5, 1984, which lS the elect10n required to place a measure before the voters submitted by the City Council. 1 ~ - SECTION 2. The ballots to be used at the Speclal Munlcipal Elect~on shall be both as to form and matter conta1ned there~n such as may be required by law. SECTION 3. The City Clerk is author1zed, ~nstructed, and d~rected to procure and furnish any and all off1cial ballots, not1ces, printed matter and all suppl~es, equ1pment, and paraphernal~a that may be necessary in order to properly and lawfully conduct the Speclal Municlpal Electlon. SECTION 4. The polls for the Spec1al Munlclpal Election shall open at 7:00 a.m. of the day of the election and shall remaln open cont1nuously until 8:00 p.m. of the same day when the polls shall be closed except as provlded 1n Elections Code Sectlon 14301. SECTION 5. The notice of the time and place of holding of the Special Mun1cipal Elect~on is hereby given and the City Clerk is author~zed, 1nstructed and directed to g~ve such further or add1tlonal not1ce of the electlon in the t~me, form, and manner requlred by law. SECTION 6. Pursuant to Elections Code Section 17050, ballots cast by voters at the Special Municlpal Election shall be counted at a central place. Santa Monica Clty Hall ~s des~gnated as the central place to count ballots. Not1ce of the central countlng place lS hereby glven, and the City Clerk is authorized, lnstructed and directed to give such further or add~tional not~ce of the central counting place in the tlme, form, and manner required by law. 2 ~ ~ SECTION 7. A proposed charter amendment that will change the date of the election for members of the Santa Mon~ca-Malibu Un1f~ed School D1strict must be placed before all voters of the distr1ct in accordance with Art~cle 9, Section 16 of the Ca11forn1a Const1tut1on. Separate ballots shall be prov1ded for those voters who reslde outside the Clty of Santa Monlca pursuant to Elect10ns Code Sect10n 23304. 3 ~ - SECTION 8. At the Spec~al Munic~pal Election, the following propos~t~on shall be subm1tted to the qual~f~ed electors of the Santa Mon1ca-Mal~bu Un1fied School D~str~ct: PROPOSITION "" Shall Sect~on 905 be added to the C~ty Charter to provide tnat the date of the election for members of the Board YES of Education of the Santa Monica-Mal1bu Un1fied School Distr~ct be changed from the second Tuesday in April of odd numbered years to the first Tuesday following the first Monday ~n November of even numbered years beg~nning in November 1984 and to NO make correspond~ng changes in the terms of elected off~cers only ~f the date of the General Mun~cipal Elect~on of the C~ty of Santa Monica is so changed? The City Clerk shall cause the text of the propos~t~on, which is conta~ned ~n Exh~b~t I attached hereto and ~ncorporated by reference, to be mailed to all qualified voters with the sample ballot. In add~tion to other not~ces and publ~cations required by law, the City Clerk, not less than 40 days and not more than 60 days before the Spec~al Mun~cipal Election, shall cause the text of the propos~t10n to be published once ~n the offic~al newspaper and ~n each edition thereof dur~ng the day of publ~cat~on. SECTION 9. Pursuant to Elections Code Section 5011, the C~ty Clerk ~s directed to transm1t a copy of the each measure to 4 ~ -- be submitted to the voters to the City Attorney and the C~ty Attorney is directed to prepare an impartial analysis of each measure in accordance w1th the prov1sions of Elections Code Section SOH. SECTION 10. In all particulars not recited in this Resolution, the Special Mun1c1pal Elect10n shall be held and conducted as prov1ded by law for holding municipal elections 1n the C1ty of Santa Mon1ca. SECTION 11. The City Clerk is d~rected to send a copy of th~s Resolut10n to the Board of Superv~sors of the County of Los Angeles and to the Registrar of Voters. SECTION 12. In the event the Special Municipal Election is consol~dated with the Statewide General Election on the same date, the prov1s1ons of th1s Resolution applicable only ~n the event the elect10n 1S conducted by the C1ty shall be of no force or effect. SECTION 13. The City Clerk shall cert1fy to the adoption of this Resolut1on, and thenceforth and thereafter the same shall be ~n full force and effect. APPROVED AS TO FORM: ~\.-,~ Robert M. EXHIBIT 1 -- ~ - PROPOSAL BY CITY COUNCIL OF THE CITY OF SANTA MONICA TO BE SUBMITTED TO VOTERS OF PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF SANTA MONICA, CALIFORNIA Section 905 shall be added to the City Charter of the City of Santa ~onica to read as follows: Section 905. G~neral Municipal Election Date for Board of Education. If Section 1400 of the '.Ci ty Charter is amended to change the date of the General Municipal Election from the second Tuesday in April of odd numbered years to the first Tuesday following the first Monday in November of even nuMbered years, such change shall be applicable to the election of members of the Board of Education under this Charter. In the event such change becomes effective, for those elected members of the Board of Education whose terms are scheduled to expire in Aoril 1985, those terms shall expire in November 1984. For those elected officers whose terms are scheduled to expire in April 1987, those terms shall expire in November 1986. The terms of the officers elected in November of even numbered years shall begin on the first Tuesday fOllowing their election.
