A RESOLUTION OF THE CITY
OF SANTA MONICA ESTABLISHING FEE
FOR FILING AND PROCESSING DEVELOPMENT
AGREEMENT APPLICATIONS AND DOCUMENTS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE
AS FOLLOWS:
SECTION 1. Pursuant to MunicIpal Code Section 9802, the
following fees are establIshed for the filIng and processIng of
any developoment agreement:
(a) The minImum fee to be charged for the filing and
processing of development agreement applIcations and documents is
hereby established at $10,000.00.
ThIS fee shall be non-
refundable, shall Include up to three hundred thIrty-three and
one thIrd (333 1/3) hours of City staff processing time and
other direct costs, and shall be due and payable upon fIling of
a development agreement applIcatIon.
(b) When the processing of a development agreement
exceeds three hundred thIrty-three and one third (333 1/3) hours
staff time, the developer shall deposit an additional $5,000
which shall be used to offset staff tIme for each additional
hour at a rate of $30.00 per hour.
(c) When a total of 500 hours staff time has been expended
and this addItIonal depOSIt has been exhausted, developer shall

be required to make successive deposIts of $5,000 Wh1Ch shall be
Slm1larly adm1n1stered 1n order that all costs of processing the
development agreement application shall be paid by the
development application fees.
SECTION 2. The C1ty Clerk shall certIfy to the adoptIon of
th1S Resolut1on, and thenceforth and thereafter the same shall be
1n full force and effect.
