R-6854 . e CA:RMM:rmpfa1 C1ty Counc1l Meet1ng 4-24-84 Santa Monica, California RESOLUTION NUMBER 6854 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING PERCENT FOR ART PROGRAM WHEREAS, the City Council of the City of Santa Monica has established an Arts Commission to carry out certain specified purposes; and WHEREAS, the Arts Comm1ssions has recommended that the C1ty Council of the City of Santa Monica adopt a Percent for the Art Program; and WHEREAS, a Percent for the Art Program wl.ll enrich the lives of all resl.dents of and vistors to the Cl.ty of Santa Mon1ca by provl.ding fundl.ng for varl.OUS forms of publ1C art, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The Percent for Art program attached hereto is hereby adopted. 1 . . SECTION 2. CITY OF SANTA MONICA PERCENT FOR ART PROGRAM Adopted by Resolution Number 6854 e (CCS) . - 1. Estab11shment. The Percent for Art Program is hereby establlshed in the city of Santa Monica. The Percent for Art Program shall be ~ncorporated into each Budget of the Ci ty of Santa Monica commencing with flscal year 1984-85. 2. Deflnitions. For purposes of the Percent for Art Program, the followlng words and phrases shall have the following meanings: (a) Art. Art lncludlng but not limited to sculpture, crafts, mixed paintlng, graphlc arts, mosaics, photography, media, and environmental works. (b) Arts Commission. The Santa Monica Arts Commission estab11shed pursuant to Munlc~pal Code Sectlon 2931. (c) ca~ital Pro~ect. Any capital proJect as defined ln the Capltal Improvement Program Budgeting Administrative Instruction involv1ng the constructlon, remodeling or renovation of property undertaken by the Clty of Santa Monica or one of lts agenc1es, which property is owned by the City or one of its agencies or lS subJect to the Beach Operating Agreement w1th the State of Callfornia, lncluding any building, park, s~dewalk or street, parking fac~lity, utility, decorative structure and includlng port~ons thereof. The following shall be excluded from the def~n~t~on of capital proJect: (1) Deslgn and research studies. (2) Purchase and renovat~on of rolling stock. (3) Urban design or art proJects. (4) Grants to private agencies. 1 . . (5) Purchase of equlpment not related to capital constructlon or renovatlon. (6) Operating costs (e.g., tree trlmmlng). (7) Acquisltlon of land (whether improved or unimproved) . (8) Any capltal prOJect for which legal restrictions preclude applicatlon of thls program. (9) Community Development Block Grants other than for the constructlon or renovatlon of public facl1ities. (d) elP Commlttee. The Committee established by the Capltal Improvement Program Budgeting Admlnistrative Instruction. (e) PFA. The Percent for Art Program. 3. Adminlstration. PFA shall be administered by the City Manager. The Arts Commission shall provlde guidance to the City Manager and asslst in the selection of art as provided for in these GUlde11nes. 4. Prorosed Budget. The proposed budget submitted to the Clty Council shall include an allocation of at least one percent (1%) for each capl tal project developed in accordance Wl th the fo1lowlng procedures: (a) The PFA allocations shall be determined by the eIP Committee and be contalned ln the capital improvement budget submltted by the City Manager to the City Council. The ClP Commlttee shall determine into which of two categories the PFA al1ocatlon shall be placed: 2 . - (1) Flrst Tier. Capltal proJects of more than $100,000 sUltable for on-site art. (Any project outside the City of Santa Monica shall be deemed unsultable for on-site art.) For these proJects, 1% of the non-art related costs shall be budgeted for on-site art. (2) Second Tier. Capltal proJects of less than $100,000 or capltal proJects of more than $100,000 for which on-site art lS unsultable. For these proJects, 1% of the non-art related costs shall be budgeted for (1) lncreased allocation for flrst tier projects, (ii) on-slte art proJects, (iil) one or more off-site proJects, and/or (lV) purchases of art for publlC dlsp1ay. Notwlthstanding the above, no a11ocatlon from any capltal proJect funded by any enterprlse fund shall be allocated except for an art proJect related to the enterprise. (b) A PFA Account shall be establlshed in the capltal budget. Appropr iation authority shall be contained in the capital budget for Flrst Tier and Second Tier projects, From time to time, the Clty Manager may recommend other budgetary procedures to approprlate and expend PFA allocations, includlng any necessary interfund transfers, (c) A PFA Administrative Account shall be establlshed in the capl tal budget for the administrative expenses of the Arts Commlssion ln carrying out PFA. Fifteen percent (15%) of each PFA allocation shall be placed ln this account. 3 . . 5. Adopted Budset, The budget adopted by the City Councll shall contain a PFA allocation for all Flrst Tier proJects. The budget adopted by the City Council may contain a PFA allocatlon for Second Tier proJects. 6. Annual ClP Art Plan, The Arts Commlssion shall coordlnate the preparatlon of an Annual Art Plan, which shall set forth speclflc proJects for the PFA allocations ln accordance with the following standards: (a) Each Department shall form one or more Selectlon Commlttees to determine the type of art for anyon-site art from lts capital proJects. The Selection Committee shall consist of one member of the Arts Commisslon, one person appolnted by the Department Head (WhlCh may be the Department Head), and one person mutually agreed to by the Arts Commission appolntee and the Department Head appolntee. One of the members of the Selectlon Committee shall be an artist. (b) The Arts Commlsslon shall form one or more Selection Committees to determlne the type of art for any off-site art. (c) The Selection Committee shall have the following responslbillties: (1) To determine the type of artwork desired for the site. The Selection Comml ttee shall consider all possible constraints on the site and shall attempt to ensure that the artwork selected is appropriate for the site's overall design and is practlcal in terms of maintenance and operation. Only low malntenance artwork shall be considered for outdoor, non-secured locations. The malntenance lmplications of the artwork shall be 4 .e -. explored w~th the appropr~ate department having maintenance respons~bility for the site. If the Selection committee determ~nes that the art should consist of a mural, the Standards and Procedures for Public Murals shall govern the proJect. (2) To work with appropr~ate review boards. (3) To solicit adv~ce from art profess~onals and from bus~nesses and residents that will be affected by the proJect. (4) To determine the method by which the artwork will be sel ec ted: ~nv i tat~on, 1 imi ted competition, open compet~t~on, or d~rect purchase. All selection must be done in accordance with applicable legal requirements. (5) To empanel a Jury, ~f ~ts determ~nes necessary, to make the select~on dec~s~on. The procedures for any jury shall be approved by the Arts Comm~ssion. (6) To recommend a maintenance schedule for the artwork, ~nclud~ng whether or not the contract with the artist w~ll include any ongo~ng malntenance responslbll~ties. (7) To prepare a report setting forth the manner in which it met its responsibilities under these Guidel~nes. (d) The Arts Commisslon shall prepare the inforrnatlon conta~ned from the various select~on committees into an Annual Art Plan. The Annual Art Plan shall be subml tted to the Commiss~on for its comments and to the City Counc~l for its approval. 7. Implementat~on of Annual Art Plan. After the Annual Art Plan has been approved by the City Counc~l, the Selection 5 . . The Commission shall approve the selectlon of the artlst and artwork, subject to appeal to the City Councll. The Arts Commission shall prepare an 8. JYlalntenance.
