A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ORDERING HEALY TIBBETTS
CONSTRUCTION COMPANY AND OTHER INTERESTED
PARTIES TO REMOVE LORAIN TRUCK CRANE, SERIAL
NUMBER 32403, FROM SANTA MONICA HARBOR
WHEREAS, On March 1, 1983, a 30 ton Lorain Truck Crane,
Model Number MC330, Serlal Number 32403, owned and being used
by Healy Tibbitts Construction Company fell into the botton of
the harbor ln the area adJacent to the Santa Pier7 and
WHEREAS, as of Aprll 24, 1984, the subject crane had not
been removed from the harbor7 and
WHEREAS, the City CounCll of the Clty of Santa Monica
has determined the removal of the subject crane was essential
to protect the public health, safety and welfare in that the
crane creates a potential hazardous condition to property and
persons using the harbor area.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Healy Tlbbetts Constructlon Company and any
other person having an interest in the crane lS hereby ordered
to effectuate the removal of the subJect crane from the harbor
within sixty (60) days from the date of service of notice.

SECTION
2.
If this order made pursuant to this
Resolut1on is not complied w1th with1n the des1gnated tlme,
the City Attorney 1S authorized to proceed with appropriate
legal action.
SECTION 3. The City Clerk shall certlfy to the adoption
of this Resolution, and thenceforth and thereafter the same
shall be in full force and effect.
