A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA WAIVING COMPETITIVE BID
PROCECDURE AND AUTHORIZING DIRECT NEGOTIATION
FOR PURCHASE OF A FOUR WHEEL LOADER FOR REFUSE
COLLECTION
WHEREAS, the City of Santa Monlca has experlenced
the loss of a four wheel loader due to fIre; and
WHEREAS, this loader is vital to the contlnuation
of effIcient refuse collectIon and dlsposal servIce; and
WHEREAS, the City PurchasIng Agent has located only
one sUItable replacement WIth lmmediate availabllty; and
WHEREAS, the competltlve bld process entalls, delay
and expense with no assurance of obtaining any competitive bids
for unlts available on an ImmedIate basis.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
The CIty Councll fInds that there
exists an lmmedlate need for a Clark 35C wheel loader, and that
to advertise for bids would be of no avaIl and would cause
unnecessary expense and delay.
SECTION 2.
CompetitIve bId procedure IS walved
and the Clty Manager IS authorIzed to negotlate dlrectly for the
purchase of a Clark 35C wheel loader.

SECTION 3.

The City Clerk shall certIfy to the
adoptIon of thIS ResolutIon I and thenceforth and thereafter the
same shall be in full force and effect.
