A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA INCORPORATING BY
REFERENCE THE TERMS OF 2 CALIFORNIA
ADMINISTRATIVE CODE SECTION 18730
PERTAINING TO CONFLICT OF INTEREST
CODES
WHEREAS, the Polltlcal Reform Act, Government Code
Section 81000 et seq. , requu:es every state or local
government agency to adopt and promulgate a Conflict of
Interest Code; and
WHEREAS, the FaIr Political PractIces Commission has
adopted a regulatIon, 2 Cal. Adm. Code SectIon 18730, which
contains the terms of a standard model ConflIct of Interest
Code, whIch can be Incorporated by reference, and which WIll
be amended to conform to amendments In the PolitIcal Reform
Act after public notIce and hearIngs conducted by the FaIr
Political PractIces CommISSIon pursuant to the AdminIstratIve
Procedure Act, Government Code SectIons 11370 et sJ~,g. j and
WHEREAS, the CIty CouncIl of the City of Santa Monica
has determIned that the attached Appendices accurately set
forth those pOSItIons which should be designated and the
categorIes of fInancIal Interests WhIch should be made
reportable,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The terms of :2 Cal. Adm. Code Section 18730
and any amendments to It that have been duly adopted by the
FaIr PolItical PractIces CommIssion, along WI th the
accompanying AppendIces A and B In which offIcials and
employees are desIgnated and disclosure categorIes are set
forth, are hereby Incorporated by reference and constitute the
ConflIct of Interest Code of the CIty and the followIng
departments, boards and commiSSIons: AIrport, Airport
CommIsSIon, Arts CommiSSIon, Attorney, BUIldIng and Safety,
Bu llding and Safety CommiSSIon} Electrical Board of Appeals,
PlumbIng and MechanIcal Board of Appeals, CIty Clerk, CiVIC
AudItorIum, CommIssion on Older AmerIcans, CommISSIon on the
Status of Women, CommunIty and EconomIC Development, HOUSIng
CommISSIon} Data ProceSSIng, Finance, FIre Department, General
SerVIces} LIbrary, LIbrary Board, City Manager, Personnel,
Personnel Board} Planning, ArchItectural ReVIew Board,
Landmarks CommiSSIon, PlannIng CommiSSIon} Police Department,
RecreatIon and Parks, RecreatIon and Parks CommISSIon, Rent
Control, Rent Control Board, SOCIal Services CommiSSIon,
TransportatIon} and ActIng ASSIgnments In DeSIgnated
POSItIons.
SECTION 2. Future amendments to the terms of 2 Cal.
Adm. Code SectIon 18730 that are duly adopted by the FaIr
PolItIcal PractIces CommISSIon shall automatically become part
of the CIty'S ConflIct of Interest Code.

SECT ION 3. Pursuant to SectIon 4(c) of the Code, all
deslgnated employees and persons holdIng desIgnated pOSItlons
In an actIng capaclty shall flIe statements of economic
interest WIth the CIty Clerk, to whom the Clty Council hereby
delegates the authorIty to carry out the dutles of fIlIng
officer.
SECTION 4. Pursuant to Sectlon 4(b) and 4(d) of the
Code, all persons assumIng or leavlng deSIgnated posltlons
must fIle statements of economIC Interest withIn thirty 1:30) -
days after assumIng or leavIng such deSIgnated pOSItIon.
SECTION 5. The CIty Clerk sha 11 certify to the adoptIon
of this ResolutIon, and thenceforth and thereafter the same
shall be in full force and effect.

General ProvIsIons
When a desIgnated employee is requIred to disclose
Investments and sources of Income, he/she need only disclose
investments 1n business entItles and sources of Income which
do busIness In the JurisdIction, plan to do business In the
Jurisdiction or have done business In the jurisdictIon wIthIn
the past two years. In addition to other actIVIties, a
business entIty IS doing busIness within the jurisdiction if
it owns real property within the jurisdIction. When a
desIgnated employee IS requIred to disclose interests In real
property, he need only disclose real property which is located
In whole or in part wIthIn or not more than two mIles outside
the boundaries of the jurisdIctIon or wIthin two miles of any
land owned or used by the local government agency.
