A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A PUBLIC HEARING AND
INSiRUCTING THE SUPERINTENDENT OF STREETS TO
GIV NOTICE TO PROPERTY OWNERS TO CONSTRUCT
GUTTERS AND TO RESURFACE VARIOUS CITY STREETS
IN CONJUNCTION WITH THE 1984-85 STREET
RESURFACING PROGRAM

WHEREAS, lr. accordance wIth SectIon 5870 et seq. of the
Streets ar:d HIghways Code procedures eXIst to r.otlfy property
owners of the~r duty to construct or cause to be constructed the
cor.crete gutters ar,d to resurface or cause to be resurfaced
streets and to dIrect the Superlrter.dent of Streets to construct
the concrete gutters and to resurface the streets if not
constructed or caused to be constructed by the property owners;

WHEREAS, the CIty Cour.cll of the City of Santa MonIca on
Its OWl" mot lor may order the construct lor of the concrete gutters
and the resurfac~ng of streets.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuar.t to Sectior 5875 of the Streets ar:d
HIghways Code, the CIty CounCIl of the CIty of Santa MonIca
orders the constructIon of corcrete gutters and the resurfacing
of streets on MIchIgan Aver:ue from Cloverfleld to City Limits I

Broadway from 17th Street to 26th Street, Nebraska from Stewart
Street to Centlnela Aver:ue ar.d commerclal/lrdustrlal port lor's of
32nd Street from PICO Boulevard to Ocean Park Boulevard, 33rd
Street from Pico Boulevard to Ocear Park Boulevard and 18th
Street from WilshIre Boulevard to Mortara Avenue.
SECTION 2. Pursuant to the Sectior 5816 of the Streets
and HIghways Code, the SuperIntendent of Streets shall notIfy, In
the manr.er required by law, the OWl"ers of property on MIchIgan
Avenue from Clover fIeld to City LImIts, Broadway from 17th Street
to 26th Street, Nebraska from Stewart Street to Centinela Avenue,
and commercial/IndustrIal protlons of 32nd Street from PICO
Boulevard to Ocean Park Boulevard, 33rd Street from Pico
Boulevard to Ocear, Park Boulevard and 18th Street from WIlshire
Boulevard to Montal"a Avenue to construct or cause to be
constructed concrete gutters and to resurface or cause to be
resurfaced streets. The notice shall contalr. the Information
required by SectIOr. 5819 of the Streets ard HIghways Code and
shall also speCIfy the day, hour and place, as set forth In
Section 3 of thIS ReSOlutIon, where the City COUl"Cll of the CIty
of Santa Monica WIll hear and pass upon ObjectIons or protests,

persons.
SECTION 3. That pursuant to SectIon 5878.1 of the
Streets and HIghways Code, the CIty Council of the CIty of Santa
MonIca does hereby order and declare that on the 26th day of
March, 1985, at 7:30 P.M. lr; the Courcll Chambers of CIty Hall,

It will hear ard pass upon objectIons or protests, if atiy, WhICh
may be raIsed by any property ow~ers or other lnterested persons.
SECTION 4. The City Clerk shall certlfy to the adoptIon
of thlS Resolutlo~ ar.d thenceforth and thereafter the same shall
be in full force ar,d effect.
