RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING GUTTER CONSTRUCTION AND STREET
RESURFACING ON VARIOUS CITY STREETS
WHEREAS, the Street Superintendent of the CIty of Santa
Monlca, pursuant to Sectlon 5870 et seq. of tte Streets and Highways
Code, commenced proceedIngs to cause gutter constructIon and street
resurfacing on Colorado between 9th and 14th Streets, MarIne between
LIncoln and 150 feet west of LIncoln, PIer between Main and NeIlson
Way, and PIer between Llncoln and 160 feet west of Lincoln; and
WHEREAS, the Superintendent of Streets served the notIce
requIred by SectIon 5876 of the Streets and HIghways Code and the CIty
Counc il of the City of Santa Monlca held the hearing required by
Section 5878.1 of the Streets and Highways Code; and
WHEREAS, SIXty (60) days after the notice was served, the work
had not been completed by the owner s or persons in possession of the
affected properties, and the SuperIntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by SectIon 5881 of the Streets and Highways Code; and
WHEREAS, the SuperIntendent of Streets dld fIle with the CIty
Counc il of the City of Santa Mo n i c a hIS report of constructIon and
cost as requlred by SectIon 5882 of the Streets and Highways Code; and

WHEREAS, upon the day and hour fIxed for hearing by Resolution
Number 6965 (CCS), the CIty CouncIl of the CIty of Santa MonIca heard
and passed upon the report of the SuperIntendent of Streets together
wIth all obJectIons and protests as requ1red by Section 5883 of the
Streets and HIghways Code;
NOw, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Super1ntendent of Streets
heretofore flIed and above-descrIbed be and the same is hereby
confIrmed.
SECTION 2. That all protests and obJections of every kInd and
nature to the report of thfr SuperIntendent of Streets be and the same
are hereby overruled and denIed.
SECTION 3. That the cost of the construct1on, as set forth 1n
the report of the Superintendent of Streets, shall be assessed against
the properties thereIn descrIbed, Wh1Ch propertIes front upon the
gutters and resurfaced streets so constructed.
SECTION 4. That if such assessment IS not paId within the
time permItted by law, the same sh a II constItute a speCIal assessment
against and lIen on the propert1es therein descr1bed, In the amount
set forth in the report of tte Superintendent of Streets, WhICh lien
shall contInue unt1l the assessment and all Interest thereon 1S paId
or until It is dIscharged of record.
SECTION 5. That 1f the assessment IS not paid w1thIn the tIme
permItted by law, the Superintendent of Streets, In accordance with

SectIon 5893 of the Streets and HIghways Code, shall deliver a Notlce
of LIen, prepared In the manner required by Section 5891 of the
Streets and Highways COde, to the County Auditor who shall collect the
assessment together with all other taxes agalnst the property.
SECTION 6. That the CIty Clerk shall certIfy to the adoptIon
of thIS resolutlon and thenceforth and thereafter the same shall be in
full force and effect.
