A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA INITIATING PROCEEDINGS
TO DETERMINE WHETHER OR NOT AND UPON WHAT
TERMS A FRANCHISE SHOULD BE GRANTED TO SHELL
OIL COMPANY FOR THE TRANSPORTATION OF CRUDE
OIL BENEATH CITY STREETS
WHEREAS, the Clty of Santa Monlca granted to Shell Oil
Company In 1941 a forty-year franchise to lay, operate and
maIntaIn a crude all plpellne beneath the CIty streets; and
WHEREAS, that franchIse has now explred and Shell Oil
Company now operates Its crude 011 pIpelIne beneath the City
streets pursuant to an lnterlm agreement; and
WHEREAS, Shell 011 Company has requested that the City
enter Into a new franchIse agreement for operatIon of Its
eXlstlng plpellne beneath the Clty streets; and
WHEREAS, the CIty and Shell 011 Company have each
obtaIned separate safety studies of the pIpeline which suggest
that safety Improvements should be made; and
WHEREAS, the Clty and Shell 011 Company have each
obtaIned separate valuatIon studles of the pIpelIne easement
WhICh reached dIsparate conclUSIons as to the value of the
easement;

WHEREAS, the Cal1fornia EnvIronmental QuaIl ty Act of
1970 requires that an Envlronmental Impact Report be prepared
on the proposed franchIse; and
WHEREAS, the CIty CouncIl of the Clty of Santa MonIca
des1res pUblIc Input on the Issues of whether a new franchIse
should be granted to Shell all Company and upon what terms,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA RESOLVES AS FOLLOWS:
SECTION 1. The CIty Council shall conduct a publIc
hearIng on the Issue of whether or not, and upon what terms, a
franch1se should be granted to Shell all Company for the
transportatIon of crude 011 beneath the CIty'S streets. The
hearIng shall take place, pursuant to publIc notIce, as soon
as the CIty has completed a Draft EnVIronmental Impact Report
upon the grantIng of the proposed franchise.
SECTION 2 The CIty Clerk shall certIfy to the adoptlon
of thIS ResolutIon, and thenceforth and thereafter the same
sha 11 be 1n full force and effect.
