R-6899 . - RESOLUTION NO. 6899 (CCS) (CITY COUNCIL SERIES) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS (SR-84-57> WHEREAS, the Street SuperIntendent of the City of Santa Monlca, pursuant to SectIon 5600 to 5630 of the Streets and Hlghways Code, commenced proceedings to cause the repair of damaged sldewalks, driveways and curbs In the CIty of Santa Monica at 2501 to 2511 Wilshlre Blvd., 463 23rd St., 218 25th St., 727 22nd St., 302-312 San Vicente Blvd., 212 San Vicente Blvd., 220 & 234 San VIcente Blvd., 316 San Vlcente Blvd., 1228 Euclid St., 1211 MIchigan, 1724 Robson, 948 24th St. '_ 1441 Eucl id and 1427 Euclld, all Wl thIn the Cl ty of Santa Monica. . WHEREAS, sixty days after sald order was served, the work had not been completed by the owners or persons in possessIon of the affected propertIes, and the Superintendent of Streets caused the work to be done; and WHEREAS, the SuperIntendent of Streets gave the notice required by SectIon 5616 of the Streets and Highways Code; and WHEREAS, the Superintendent of Streets did file WIth the City Council of the City of Santa MonIca hIS report of repaIrs and cost as required by SectIon 5617 of the Streets and Highways Code; and WHEREAS, upon the day and hour f1xed for hear1ng by ResolutIon Number 6884 (CCS), the CIty Council of the City of Santa MonIca heard and passed upon the report of the Superintendent of Streets together . . with all objections and protests as requHed by Sect~on 5618 of the Streets and H~ghways Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA , DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the report of the Superintendent of Streets heretofore filed and above-descr~bed be and the same ~s hereby confirmed. SECTION 2. That all protests and obJect~ons of every kind and nature to the report of the Superintendent of Streets be and the same are hereby overruled and den~ed. SECTION 3. That the cost of the repa~rs, as set forth in the report of the Superintendent of Streets, shall be assessed aga~nst the propert~es there~n described, wh~ch propert~es front upon the sidewalk upon wh~ch the repa~rs were made. SECTION 4. That if such assessment ~s not paid withln the time permitted by law, the same shall constitute a special assessment against and lien on the propertles therein described, in the amount set forth ln the report of the Superintendent of Streets, which lien shall continue until the assessment and all interest thereon 1S pald or unt11 1t 1S d1scharged of record. SECTION 5. That if the assessment 1S not paid within the tlme perml tted by law, the Superlntendent of Streets, in accordance Wl th Sectlon 5628 of the Streets and Highways Code, shall deliver a Notice of Lien, prepared ln the manner required by Sectlon 5626 of the . . Streets and Highways Code, to the County Auditor who shall collect the assessment together with all other taxes against the property. SECTION 6. That the City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
