A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AMENDING THE EXECUTIVE PAY PLAN
WHEREAS, the Execut1ve pay plan adopted by Resolutlon No.
6753 (CCS) has been In effect for one year; and
WHEREAS, certaIn of lts provIsIons requ1re updatlng to
reflect organIzatIonal changes and to update compensatlon and
benefIt provlslons.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1: The CIty Councll does hereby establ1sh an
Executlve Pay Plan WhICh defInes the wages and beneflts of the
C1ty'S Department Heads and those members of the Executlve Staff
of the Clty Manager's Off1ce who choose to represent themselves
lndlvldually under Ordlnance Number 801.
SECTION 2: The elements of the Execut1ve Pay Plan shall be
as follows:
A. Partlclpants. Partlclpatlon In the ExecutIve Pay Plan

Members of the City Manager's Executlve Staff who choose to be
lndiVidually represented and become participants 1n the Executive
Pay Plan shall have the r1ght to stop partic1pation in the

and
to
request
representation
by
an
appropr1ate unlt.
Individuals .....ho exerCise that right cannot
aga1n become part1C1pants 1n the Execut1\re Pay Plan during the
term of th1s Resolutlon.
B. July 1, 1984 Wa~e AdJustments. Effect1ve July 1, 1984,
the E-step salarles for the participants in the Executive Pay
Plan shall be adJusted as follows:

1985, the E-step salar1es of Executlve Pay Plan partlclpants
shall be adJusted by the percentage lncrease 1n the Revised
Consumer Pr1ce Index (For urban Wage Earners and Clerlcal
Workers, 1967=100) for LOS Angeles-Long Beach-Anahelm, publlshed
by the Unlted States Department of Labor, Bureau of Labor
Stat1stlcs, from April 1, 1984 to March 31, 1985, prov1ded,
however, that the percentage wage adJustment shall not be less
than three percent (3%) or greater than flve percent (5%).

Hours of Work and Overtlme.

Part1c1pants 1n the Execut1ve Pay Plan may not

accrue compensatory t1me. However, the C1ty Manager's Office
Adm1n1strator and the Counc11 Off1ce Adm1n1strator may rece1ve
overt1me pay when work performed outs1de the normal bus1ness
hours of the C1ty 1S also clearly outs1de the scope of their
ass1gned Departmental respons1bl11t1es.
F. Performance Based Coml?ensat10n. The C1 ty Manager or
hlS desglnee shall evaluate the performance of part1cipants In
the Execut1ve Pay Plan annually. The evaluatIon shall be made no
later than 45 days followIng the end of any fiscal year. SaId
evaluatIon shall 1nclude an assessment of general management
SkIlls and spec1f1c accomplIshments of each lndlvldual employee.
The CIty Manager or hIS des1gnee shall meet wlth each lndlvldual
employee to dlSCUSS the evaluat10n and shall establlsh mutually
agreed upon performance cr1ter1a upon .....hlCh the follow1ng year's
evaluatlon shall be based. The oral evaluat10n shall be followed
by wrltten evaluatIon wlthln ten (10) work1ng days 1f the
employee so requests or If the Clty Manager or hIS des1gnee deems
1t advisable.
When, 1n the op1n10n of the C1 ty Manager, the capabil i t1es and
accomplIshments of an 1nd1vldual employee have been except10nally
mer1tor10US a cash payment of one percent (1%) to ten percent
(10%) of that employee's annual salary on June 30 of the flscal
year for WhlCh performance IS belng evaluated shall be made. The
bonus shall be pald no later than 30 days follow1ng the date of
the evaluat1on. Sa1d payments shall be regarded as one tlme
bonuses and shall not become part of the employee's base salary.

If, 1n the op1n1on of the C1ty Manager, no cash payment or pa1d
t1me off 1ncent1ve 1S warranted by an employee's performance, the
employee shall have the opportun1ty to present, w1th1n ten days
of not1f1cat1on that no payment 15 due, add1 t10nal 1nformat1on
that m1ght alter the C1 ty Manager's dec1s1on. The dec1s1on of
the C1ty Manager, after cons1derat1on of any such add1t1onal
1nformat1on, shall be f1nal and no appeal may be taken therefrom.
It 1S expressly understood by part1c1pants 1n the Execut1ve Pay
Plan that the performance-based payments described in this
sect10n do not const1tute a generally granted 1ncrease under
Sect10n 1100 of the C1ty Charter and Sect10n 2l05E of the
Mun1c1pal Code, and that den1al of such payments does not
COnSt1tute a demot1on.
G. Deferred Compensat1on. Part 1C 1pants 1n the Execut1 ve
Pay Plan who part1c1pate 1n the C1ty'S Deferred Compensation Plan

shall rece1ve from the C1 ty an amount equal to the amount that
the employee lS contr 1but1ng toward the Deferred Compensat1on
Plan, to a maX1mum of $75.00 per month.
H. Annual Phys1cal Exam. Part1c1pants 1n the Execut1 ve
pay plan shall rece1ve an annual physical exam1nat1on at C1ty
expense.
I. Mental Health Insurance. partlclpants 1n the Execut1ve
Pay Plan shall rece1ve mental health 1nsurance coverage at C1ty
expense.
J. Long Term D1sab1l1ty Insurance. Part1c1pants 1n the
Execut1ve Pay Plan shall rece1ve long term dlsab111ty 1nsurance
coverage at C1ty expense. SubJect to the usual prov1s1ons and
exclus10ns of such 1nsurance plans, the coverage shall be for 60%
of salary after a 180 day el1mlnat1on perlod.
K.
Heal th and Dental Insurance.
The C1ty shall pay the
full prem1um of eX1st1ng fee for service or health ma1ntenance
organ1zat1on (HMO) coverage for part1c1pants 1n the Execut1ve pay
Plan and el1g1ble dependents. In F1scal Year 1985-86, the C1ty
may ralse the fee for serVlce deduct1ble to a maX1mum of $200 per
1ndlV1dual famlly member and may requ1re that the employee
contr1bute the d1fference 1n prem1um between co-payment HMO's and
non-copayment HMO's.
L. Management Leave. Part1c1pants 1n the Execut1ve pay
Plan shall rece1 ve S1X management leave days per f1scal year.
Payment at the employee's base salary rate for any unused

management leave days shall be payable to the employee upon
term1nat1on or w1th1n th1rty days from the end of the f1scal year
1n Wh1Ch the leave days .....ere earned by unused.
M. Vacat10n Leave. part1cipants 1n the Execut1ve pay Plan
shall rece1ve vacat10n leave as prov1ded 1n Sect10n 2104H of the
Mun1c1pal Code, prov1ded, however, that the City Manager may
author1ze the accrual of vacat10n beyond the llm1ts of Section
2l04H in 1nd1vidual cases where the employee has been unable to
use vacat10n due to work demands.
N.
S1ck Leave.
Part1c1pants 1n the Execut1ve Pay plan
shall earn slck leave as follows:
(1) Upon completion of SiX months of serV1ce, SlX days.
(2) Thereafter, one day per completed month of service.
Other s1ck leave prov1S10ns shall be as conta1ned 1n Sect10n
2l04I of the Mun1C1pal Code except that partic1pants 1n the
Execut1ve Pay Plan may elect annually to rece1ve a payoff at
the1r base salary rate for unused s1ck leave as follows:

P. over~ayment Remedy. Part1c1pants 1n the Execut1ve Pay
plan shall re1mburse the C1 ty for any overpayment of wages or
benef1ts.
Said re1mbursement shall not be requ1red unt1l the
C1ty notif1es the affected employee 1n wr1 t1ng.
Re1mbursement
may be accompl1shed by a lump sum deduct10n from the next payroll
warrant 1ssued to the employee follow1ng not1flcat1on, or by
other reasonable repayment method mutually acceptable to the

employee and the Cl ty, except that lump sum deduct10n shall be
requlred 1f the next payroll warrant issued to the employee 15
the flnal or termlnatlon warrant.
SECTION 3.
ThlS resolutlon shall be effectlve for the
perlod of July 1, 1984 to June 30, 1986. Effect1ve July 1, 1986,
th1s Resolutlon shall be deemed repealled and of no further force
and effect.
SECTION 4.
Resolutlon Number 6753 and 6886 are hereby
repealled.
SECTION 5. The Clty Clerk shall certlfy to the adoptlon of
th1s Resolutlon and thenceforth and thereafter the same shall be
in full force and effect.
