RESOLUTION NO. 6917 (CCS)

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-84-58)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Sect~on 5600 to 5630 of the Streets and H~ghways
Code, commenced proceed~ngs to cause the repa~r of damaged s~dewalks,
driveways and curbs ~n the C~ty of Santa Monica at 1604 San
VIcente,1526 San V~cente, 211 San Vicente, 2617 Wash~ngton, 266 21st
Place, 229 San Vicente, 404 San VIcente, 225 San Vicente, 621 San
VIcente, 537 San Vicente, 527 San Vlocente, 305 San V~cente, 521 San
VIcente, 630 San V~cente, 326 San V~cente, 416 San V~cente, 515 San
Vicente, and 511 San V~cente, all wloth~n the c~ty of Santa Monica.
WHEREAS, s~xty days after said order was served, the work had
not been completed by the owners or persons ~n possess~on of the
affected properties, and the SuperIntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
requ~red by Sect~on 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets d~d file with the C~ty
Counc~l of the City of Santa Monica hls report of repa~rs and cost as
requ~red by Section 5617 of the Streets and Highways Code; and
WHEREAS, upon the day and hour f~xed for hearing by Resolut~on
Number 6896 (CCS), the C~ty Counc~l of the C~ty of Santa Mon~ca heard
and passed upon the report of the SuperIntendent of Streets together

with all objections and protests as requ:Lred by Sect:Lon 5618 of the
Streets and H:Lghways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of Streets
heretofore filed and above-desoribed be and the same lS hereby
confirmed.
SECTION 2. That all protests and object:Lons of every k:Lnd and
nature to the report of the Super:Lntendent of Streets be and the same
are hereby overruled and denied.
SECTION 3. That the cost of the repalors, as set forth in the
report of the Superintendent of Streets, shall be assessed aga:Lnst the
properties therein described, wh:Lch propert:Les front upon the s:Ldewa1k
upon which the repairs were made.
SECTION 4. That:Lf such assessment is not paid within the
time permitted by law, the same shall const:Ltute a special assessment
aga:Lnst and lien on the propert:Les therein descr:Lbed, in the amount
set forth in the report of the Super:Lntendent of Streets, which lien
shall contlonue until the assessment and all :Lnterest thereon :LS paid
or unt:Ll :Lt :LS discharged of record.
SECTION 5. That:Lf the assessment is not pa:Ld within the time
perm:L tted by law, the Super intendent of Streets, :Ln accordance with
Sect:Lon 5628 of the Streets and H:Lghways Code, shall deliver a Not:Lce
of Lien, prepared in the manner required by Section 5626 of the

Streets and Highways Code, to the County Auditor who shall collect the
assessment together with all other taxes agaLnst the property.
SECTION 6. That the City Clerk shall certLfy to the adoptLon
of thLs resolutLon and thenceforth and thereafter the same shall be in
full force and effect.
