CA:RMM:rmabank C:ty Councll Meetlng 10-9-84 Santa Mon:ca, Ca11fornla RESOLUTION NUMBER 6927(CCS) (City Councll Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING THE ART BANK POLICY WHEREAS, the City Councl1 of the Clty of Santa Monica has establlshed an Arts Commlsslon to carry out certain specified purposes; and WHEREAS, the Arts Commisslon has recommended that the City Council of the City of Santa Monica adopt an Art Bank Program; and WHEREAS, an Art Bank Program will enrich the lives of all resldents of and visltors to the Clty of Santa Monica by provldlng funding for varlOUS forms of publlC art, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The Art Bank Program attached hereto is hereby adopted. 1 . . SECTION 2. CITY OF SANTA MONICA ART BANK PROGRAM . Adopted by Resolutlon Number 6927 (CCS) 3 . . 1. Establishment. The Art Bank Program is hereby estab11shed ln the Clty of Santa Monica. 2. Goals and Purpose. The goals of the Art Bank are: (al To brlng contemporary art into the enVlronment and llfe of Santa Monica. (bl To encourage both emerging and established artlsts by supporting and purchasing thelr work. (cJ To acqulre a dlstlngulshed art collection for the Clty of Santa Monica. (dJ To document the history of art in Santa Monica. The selected purchased resIdent Art Bank wIll function as a reposltory for artwork by the Arts Commission or lts representatives, and for the City of Santa Monica. The work of both and non-resldent artlsts wIll be considered for purchase. The Art Bank will make the artworks accessible to the general pub11C through exhlbltions and loans. The Art Bank Collectlon will be dlsplayed ln the lnteriors and grounds of pUblIC spaces such as City Hall, schools, libraries and parks. The Art Bank Collectlon wlll be a valuable resource for communlty organlzations, museums, and gallerles who may, by complying wlth speclfled procedures, borrow works for exhlblt and educational purposes. The Collection will also function as an archival source for hIstorical reference. 3. Definitions. For purposes of the Art Bank Program, the following words and phrases shall have the following meanlngs: 4 . . (al Art. Art includlng, but not sculpture, palnting, graphic arts, mosaics, crafts, mlxed medla and envlronmental works. (bl Arts Commlssion. The Santa Monica Arts Commlssion established pursuant to Munlclpal Code Section 11mited to, photography, 2931. (cl ABP. Art Bank Program. 4. Appointment of Jurors. The Arts Commlsslon wlll appoint three jurors for the Art Bank for a one year term at the beglnnlng of each fiscal year. Jurors may be reappionted for a second term, but may not be reappointed for three years after the end of anyone year term. A maJority of jurors shall live or work ln the Clty of Santa Monica. Each jury shall include at least one artlst. Other jurors will include acknowledged experts ln contemporary art: collectors, critics, hlstorlans, educators, etc. One member of the Arts Commission may be appointed as a juror. 5. Annual Purchase Program. At the beginning of each fiscal year, the Art Bank jury will prepare a plan for the expenditure of funds made available by the adopted budget for the flscal year. This plan shall Include the number and types of artwork to be purchases. Prlor to any purchase of artwork, the Annual Purchase Program must be adopted by the Arts CommiSSion. Based on the Annual Purchase Plan, the Arts Commission will establ:sh review periods and application procedures for the year. 5 . . 6. Selection of gUidelines shall be artwork: Artwork for used by the ~urchase. (bl All works will be purchased at the most favorable price to the Clty, which wlll be determlned on a case-by-case basls. (cl During the year of thelr servlce, members of the jurles of the Art Bank and the Percent for Art Program (and lts Advlsory Commltteel may not have thelr works of art considered for purchase. 7. D:solay POliCY' Each year, the Arts Commission will publlcize to all City departments and agenCies all artworks that are avallable for display. Department Directors and City officials will then make their requests for works of art to the Arts Commission, WhiCh will decide the loans to be made. All work from the Art Bank will be displayed only in public areas ln public faci1itles and in public ceremonla1 spaces. Artwork will be on display for one year perlods of time. 8. Administration. (d) Securlty. Securlty and all associated costs are the responsiblllty of the borrowing Department. If artwork is lost or damaged, the Arts CommissIon must be notifled lmmediately. (e) Malntenance. Maintenance and all ordInary costs are the responsIb1llty of the borrowing Department. (fJ Storag~. Storage of artwork not on display and all associated costs will be the responsibllity of the Arts Commission. (gJ Staffing. StaffIng the Art Bank, lncluding all support serv1ces, support for the Jury, and all associated costs, wlll be the responsibillty of the Arts Commission. (hJ Honorarium Jurors who are not members of the Arts Commlssion may receive an honorarium from the Commlssion. Jurors who 11ve or work 1n the City of Santa Monlca will be requested to volunteer thelr service as Jurors. Jurors who are current members of C1ty boards and commissions will not be paid for thelr serVlce. Former members of the Arts Commission who are servlng as jurors wlll not be eligible 7 . . to be paid for the1r service for one year after the expiration date of the1r service as an Arts Comm1ssloner. (i) Unusual Costs. Any unusual transportation, installatlon, and/or maintenance costs will be the responslbl11ty of the Arts CommIssion. 9. Permanent Loans, Donations and Bequests. fa) The Arts Comm1ss:on will only consider offers of artworks to the Art Bank that are permanent loans, unencumbered gifts, and bequests. (bl A donor who wlshes to make such an offer must send a letter to the Arts Commlssion that contains the following lnformat1on: (ll The type of donation being made. (2l Documentation materials of the artwork being offered for donation, lnclud1ng pictures, slides, size, med1um, tlt1e, year of creation, etc., and a resume of the art1st, if posslb1e. (3) Maintenance requirements of the artwork. (~J A document showing that the artwork 15 free of encumbrance. (5) A release letter by the donor, should the Arts Commlsslon declde to deaccess the artwork in the future. (cl The City of Santa Monlca will acknowledge receipt of the donated artwork wlthout any valuation for tax purposes. The donor must flnd other means of establlshlng a value of the artwork. B . . (d) The Arts Commlssion will present all proposals for donated artworks to the Art Bank jury for consideration. (e) Based on thlS recommendation of the Art Bank jury, the Arts Commission w:1l declde on accepting all offers of donated artworks and will notify donors of its decislons withln ninety (90) days. If) Any loan or any restr:cted gift must be reviewed and approved by the City Manager ln consultation with the City Attorney. 10. External Loans. Museum and private curators may apply to the Arts Commission for artworks in the Art Bank to be lnc1uded ln exhiblts ln the City of Santa Monica and temporary exhlbits outslde the City of Santa Monlca. Rental fees shall be charged for such loans. 11. Travel,ng ExhlbltS. Arts Commisslon staff may organize traveling exhibits in the City of Santa Monica from the Art Bank and temporary traveling exhibits outside the City of Santa Monlca. 12. Reproduction Rlohts. ReproductIon rlghts, if any, shall be established in an agreement between the Clty and the artist. 13. Deaccession. Deaccesslon of any piece of artwork ln the Art Bank may be considered if the artwork has not been publlC1y displayed over a five year period. The deCision to deaccess a piece of artwork shall be made by the Arts Commission upon the adVice of the current year jury.
