A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA APPROVING THE PROVISION OF
LOW AND MODERATE INCOME REPLACEMENT HOUSING
AND FINDING THAT SUCH EXPENDITURE WILL BE
OF BENEFIT TO THE OCEAN PARK
REDEVELOPMENT PROJECT
WHEREAS, it is the policy of this locality to ensure an
adequate supply of housing affordable to low and moderate
income persons and families; and
WHEREAS, Ocean Park Redevelopment Projects 1(8) and l(b)
(hereinafter collectively "Ocean Park Redevelopment Project")
has been established in the City of Santa Monica; and
WHEREAS, Ocean Park Redevelopment Project caused the
demolition of more than 700 low and moderate income housing
units; and
WHEREAS, the Redevelopment Agency of the City of Santa
Monica seeks to invoke the provisions of Health and Safety
Code Section 33334.2 and make them applicable to the Ocean
Park Redevelopment Project for the purpose of replacing the
supply of housing demolished due to redevelopment activity in
the Project Areaj-and
WHEREAS, Health and Safety Code Section 33334.2 requires
that the City Council concur with the Redevelopment Agency's
finding that the use of the funds will be of benefit to the
Redevelopment Project Area when the funds will be expended
outside the boundaries of the Redevelopment Project Area; and

WHEREAS, the Redevelopment Agency has determined that
replacing the supply of low and moderate income housing
available at affordable costs outside of the Project Area will
benefit the Ocean Park Redevelopment Project; and
WHEREAS, Health and safety Code Section 33334.2(g)
provides that the provision of replacement housing as defined
in Health and Safety Code Section 33413 is conclusively deemed
to
be
benefit to a redevelopment project by the
of
~egislature; and
WHEREAS, a judgment was entered in the superior Court of
~os Angeles on August 12, 1983, requiring the Agency and City
to comply with the terms of an Amended Sales Agreement for
Private Development (the "Amended Sales Agreement") pertaining
to completion of Phase II of the Ocean Park Redevelopment
Project Area; and
WHEREAS, said Amended Sales Agreement imposes a legal
obligation upon the Agency to construct 55 units of housing
affordable to low and moderate income persons and families
within the area bounded by Pico and Lincoln Boulevards, the
City boundaries, and the Pacific Ocean; and
WHEREAS, Agency desires to expend Agency funds in the
amount of $3,500,000 in order to construct said 55 units of
low and moderate income replacement housing, outside of the
boundaries of the Ocean Park Redevelopment Project Area;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. The Clty Council finds and determines that
the Ocean Park Redevelopment Project Area will benefit by the
provision of 5S units of low and moderate income replacement
housing in accordance with Health and Safety Code Section
33413 and 33334.2, as well as in accordance with the Agency's
legal obligation to comply with the terms of the Amended Sales
Agreement
for
of the Ocean Park
Private
Development
Redevelopment Project Area which includes a requirement for
the construction of such low and moderate income housing. The
City Council hereby consents to the expenditure of $3,500,000
of Agency funds for purposes of providing the low and moderate
income housing described herein.
SECTION 2. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same
shall be in full force and effect.
