RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS)
DRIVEWAYS AND CURBS (SR-85-69)
WHEREAS) the Street Superintendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and Highways
Code, commenced proceedings to cause the repaIr of damaged sidewalks,
drlveways and curbs in the City of Santa MonIca at 1814 Hill St., 1746
Oak St., 1752 Oak St., 2509 18th St., 2614 31st St., 2640 31st St.,
1634 HIll St., 2417 Hill St., 2470 Ocean Park Blvd., 1700 Ocean Park
Bl v d . , 1736 Oak St., 1043 Pine St., 1001 Pine St., 1221 MichIgan Ave.,
2424 Euclid St., 1666 Ashland Ave., and
WHEREAS, Sixty days after saId order was served, the work had
not been completed by the owners or persons In possession of the
affected properties, and the Superintendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by SectIon 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets dId file wIth the City
CouncIl of the City of Santa MonIca hIS report of repairs and cost as
required by SectIon 5617 of the Streets and HIghways Code; and
WHEREAS, upon the day and hour fIxed for hearIng by ResolutIon
Number 7057 (CCS) , the CIty CouncIl of the City of Santa MonIca heard
and passed upon the report of the Superintendent of Streets together
wIth all Objections and protests as requIred by Section 5618 of the
Streets and Highways Code;

NOW, THEREFORE, THE CITY COUNCIL OF THE C I'rY OF SAN'rA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION L The report of the Superintendent of Streets
heretofore filed and above-descrlbed be and the same is hereby
conf1rmed"
SECTION 2.. All protests and Ob)ectlons of every kind and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denied"
SECTION 3.. The cost of the repairs, as set forth in the
report of tne Super1ntendent of Streets, shall be assessed aga1nst the
properties thereln described, which properties front upon the sidewalk
upon Wh1Ch the repairs were made.
SECTION 4.. If such assessment 1S not paid within the tlme
perm1tted by law, the same shall const1tute a special assessment
aga1nst and llen on the properties there1n described, in the amount
set forth in the report of the Superintendent of Streets, which lien
shall contlnue untll the assessment and all 1nterest thereon 1S pa1d
or untll It 1S dlscharged of record..
SECTION 5.. If the assessment 1S not pald within the time
perm1tted by law, the Super1ntendent of Streets, in accordance with
SectIon 5628 of the Streets and H1ghways Code, shall deliver a Not1ce
of Lien, prepared 1n the manner requlred by Sectl.on 5626 of the
Streets and Highways Code, to the County Aud1tor who shall collect the
assessment together with all other taxes agal.nst the property..

SECTION 6. The Clty Clerk shall certlfy to the adoption of
this resolution and thenceforth and thereafter the same shall be in
full force and effect.
